A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the compensation received by state peace officers who
1-3 are required to work on certain holidays.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 662.005, Government Code, is amended by
1-6 adding a new Subsection (b) and relettering the existing Subsection
1-7 (b) as Subsection (c) to read as follows:
1-8 (b) Except as provided by Section 662.010, and
1-9 notwithstanding Section 659.015 or another law, a state employee
1-10 who is a peace officer under Article 2.12, Code of Criminal
1-11 Procedure, and who is required to work on a national or state
1-12 holiday that falls on a Saturday or Sunday is entitled to
1-13 compensatory time off at the rate of one hour for each hour worked
1-14 on the holiday.
1-15 (c) [(b)] In this section, "state employee":
1-16 (1) includes an individual who uses paid leave from a
1-17 state agency; and
1-18 (2) does not include an individual who uses unpaid
1-19 leave from a state agency.
1-20 SECTION 2. This Act takes effect September 1, 2001.
