                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the issuance of Texans Conquer Cancer license plates.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subchapter F, Chapter 502, Transportation Code,
 1-5     is amended by adding Section 502.2735 to read as follows:
 1-6           Sec. 502.2735.  TEXANS CONQUER CANCER LICENSE PLATES.
 1-7     (a)  The department shall issue specially designed license plates
 1-8     for passenger cars and light trucks that include the words "Texans
 1-9     Conquer Cancer."
1-10           (b)  The department shall design the license plates in
1-11     consultation with the Texas Cancer Council.
1-12           (c)  The department shall issue license plates under this
1-13     section to a person who:
1-14                 (1)  applies to the assessor-collector of the county in
1-15     which the person resides on a form provided by the department; and
1-16                 (2)  pays an annual fee of $30, in addition to the fee
1-17     prescribed by Section 502.161 or Section 502.162 and, if
1-18     personalized prestige license plates are issued, in addition to the
1-19     fee prescribed by Section 502.251.
1-20           (d)  Of each fee collected under Subsection (c)(2), $5 shall
1-21     be used by the department only to defray the cost of administering
1-22     this section.  The department shall deposit the remainder of each
1-23     fee collected to the credit of the Texans Conquer Cancer account
1-24     established by Section 102.017, Health and Safety Code.
1-25           (e)  If the owner of a vehicle for which license plates were
 2-1     issued under this section disposes of the vehicle during a
 2-2     registration year, the owner shall return the special license
 2-3     plates to the department.
 2-4           SECTION 2.  Chapter 102, Health and Safety Code, is amended
 2-5     by adding Sections 102.017 and 102.018 to read as follows:
 2-6           Sec. 102.017.  TEXANS CONQUER CANCER ACCOUNT.  (a)  The
 2-7     Texans Conquer Cancer account is a separate account in the general
 2-8     revenue fund.  The account is composed of:
 2-9                 (1)  money deposited to the credit of the account under
2-10     Section 502.2735, Transportation Code; and
2-11                 (2)  gifts, grants, and donations.
2-12           (b)  The council administers the account.  The council may
2-13     spend money credited to the account only to:
2-14                 (1)  make grants to nonprofit organizations that
2-15     provide support services for cancer patients and their families;
2-16     and
2-17                 (2)  defray the cost of administering the account.
2-18           (c)  The council:
2-19                 (1)  may accept gifts, donations, and grants from any
2-20     source for the benefit of the account; and
2-21                 (2)  by rule shall establish guidelines for spending
2-22     money credited to the account.
2-23           Sec. 102.018.  TEXANS CONQUER CANCER ADVISORY COMMITTEE.
2-24     (a)  The council shall appoint a seven-member Texans Conquer Cancer
2-25     advisory committee.
2-26           (b)  The committee shall:
 3-1                 (1)  assist the council in establishing guidelines for
 3-2     the expenditure of money credited to the Texans Conquer Cancer
 3-3     account; and
 3-4                 (2)  review and make recommendations to the council on
 3-5     applications submitted to the council for grants funded with money
 3-6     credited to the Texans Conquer Cancer account.
 3-7           (c)  Members of the committee serve without compensation and
 3-8     are not entitled to reimbursement for expenses.  Each member serves
 3-9     a term of four years, with the terms of three or four members
3-10     expiring on January 31 of each odd-numbered year.
3-11           (d)  Section 2110.008, Government Code, does not apply to the
3-12     committee.
3-13           SECTION 3.  This Act takes effect immediately if it receives
3-14     a vote of two-thirds of all the members elected to each house, as
3-15     provided by Section 39, Article III, Texas Constitution.  If this
3-16     Act does not receive the vote necessary for immediate effect, this
3-17     Act takes effect September 1, 2001.
