 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the issuance of Texans Conquer Cancer license plates.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1.  Subchapter F, Chapter 502, Transportation Code,
1-11     is amended by adding Section 502.2735 to read as follows:
1-12           Sec. 502.2735.  TEXANS CONQUER CANCER LICENSE PLATES.
1-13     (a)  The department shall issue specially designed license plates
1-14     for passenger cars and light trucks that include the words "Texans
1-15     Conquer Cancer."
1-16           (b)  The department shall design the license plates in
1-17     consultation with the Texas Cancer Council.
1-18           (c)  The department shall issue license plates under this
1-19     section to a person who:
1-20                 (1)  applies to the assessor-collector of the county in
1-21     which the person resides on a form provided by the department; and
1-22                 (2)  pays an annual fee of $30, in addition to the fee
1-23     prescribed by Section 502.161 or Section 502.162 and, if
1-24     personalized prestige license plates are issued, in addition to the
1-25     fee prescribed by Section 502.251.
1-26           (d)  Of each fee collected under Subsection (c)(2), $5 shall
1-27     be used by the department only to defray the cost of administering
1-28     this section.  The department shall deposit the remainder of each
1-29     fee collected to the credit of the Texans Conquer Cancer account
1-30     established by Section 102.017, Health and Safety Code.
1-31           (e)  If the owner of a vehicle for which license plates were
1-32     issued under this section disposes of the vehicle during a
1-33     registration year, the owner shall return the special license
1-34     plates to the department.
1-35           SECTION 2.  Chapter 102, Health and Safety Code, is amended
1-36     by adding Sections 102.017 and 102.018 to read as follows:
1-37           Sec. 102.017.  TEXANS CONQUER CANCER ACCOUNT.  (a)  The
1-38     Texans Conquer Cancer account is a separate account in the general
1-39     revenue fund.  The account is composed of:
1-40                 (1)  money deposited to the credit of the account under
1-41     Section 502.2735, Transportation Code; and
1-42                 (2)  gifts, grants, and donations.
1-43           (b)  The council administers the account.  The council may
1-44     spend money credited to the account only to:
1-45                 (1)  make grants to nonprofit organizations that
1-46     provide support services for cancer patients and their families;
1-47     and
1-48                 (2)  defray the cost of administering the account.
1-49           (c)  The council:
1-50                 (1)  may accept gifts, donations, and grants from any
1-51     source for the benefit of the account; and
1-52                 (2)  by rule shall establish guidelines for spending
1-53     money credited to the account.
1-54           Sec. 102.018.  TEXANS CONQUER CANCER ADVISORY COMMITTEE.
1-55     (a)  The council shall appoint a seven-member Texans Conquer Cancer
1-56     advisory committee.
1-57           (b)  The committee shall:
1-58                 (1)  assist the council in establishing guidelines for
1-59     the expenditure of money credited to the Texans Conquer Cancer
1-60     account; and
1-61                 (2)  review and make recommendations to the council on
1-62     applications submitted to the council for grants funded with money
1-63     credited to the Texans Conquer Cancer account.
1-64           (c)  Members of the committee serve without compensation and
 2-1     are not entitled to reimbursement for expenses.  Each member serves
 2-2     a term of four years, with the terms of three or four members
 2-3     expiring on January 31 of each odd-numbered year.
 2-4           (d)  Section 2110.008, Government Code, does not apply to the
 2-5     committee.
 2-6           SECTION 3.  This Act takes effect immediately if it receives
 2-7     a vote of two-thirds of all the members elected to each house, as
 2-8     provided by Section 39, Article III, Texas Constitution.  If this
 2-9     Act does not receive the vote necessary for immediate effect, this
2-10     Act takes effect September 1, 2001.
