1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to extension of restrictions imposing regular assessments
1-9 in certain residential real estate subdivisions.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 206.002, Property Code, is amended to
1-12 read as follows:
1-13 Sec. 206.002. APPLICABILITY OF CHAPTER. This chapter
1-14 applies only to:
1-15 (1) a residential real estate subdivision that:
1-16 (A) [(1)] consists of at least 4,600 homes;
1-17 (B) [(2)] is located in whole or in part in a
1-18 municipality with a population of more than 1.6 million located in
1-19 a county with a population of 2.8 million or more; and
1-20 (C) [(3)] has restrictions the terms of which
1-21 are automatically extended but has a regular assessment that is
1-22 established by a separate document that permits the assessment to
1-23 expire and does not provide for extension of the term of the
1-24 assessment; or
1-25 (2) a residential real estate subdivision that:
1-26 (A) consists of at least 750 homes;
1-27 (B) is located in two adjacent municipalities in
1-28 a county with a population of 2.8 million or more; and
1-29 (C) has use restrictions the terms of which are
1-30 automatically extended but has a regular assessment that is
1-31 established by two separate documents that permit the assessment to
1-32 expire and do not provide for extension of the term of the
1-33 assessment.
1-34 SECTION 2. This Act takes effect September 1, 2001.
