No. 624 By: Shapleigh 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to the prohibition of certain waivers by employers and 1-11 employees under the workers' compensation system. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Section 406.033, Labor Code, is amended by adding 1-14 Subsection (e) to read as follows: 1-15 (e) A cause of action described in Subsection (a) may not be 1-16 waived by an employee prior to the employee's injury or death. Any 1-17 agreement by an employee to waive a cause of action or any right 1-18 described in Subsection (a) prior to the employee's injury or death 1-19 is void and unenforceable. 1-20 SECTION 2. This Act applies only to an injury that occurs on 1-21 or after the effective date of this Act. 1-22 SECTION 3. This Act takes effect immediately if it receives 1-23 a vote of two-thirds of all the members elected to each house, as 1-24 provided by Section 39, Article III, Texas Constitution. If this 1-25 Act does not receive the vote necessary for immediate effect, this 1-26 Act takes effect September 1, 2001. 1-27 * * * * *
