No. 636 1-2 (In the Senate - Filed February 8, 2001; February 12, 2001, 1-3 read first time and referred to Committee on Criminal Justice; 1-4 March 12, 2001, reported favorably by the following vote: Yeas 6, 1-5 Nays 0; March 12, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the analysis and review of mental illness treatment 1-9 programs for certain juvenile and adult offenders. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. (a) Not later than May 1, 2002, the Texas 1-12 Department of Criminal Justice shall conduct a cost-benefit 1-13 analysis of the potential use of the Texas Medication Algorithm 1-14 Project, as developed by the Texas Department of Mental Health and 1-15 Mental Retardation, to treat persons with mental illness in the 1-16 custody of the department. 1-17 (b) Not later than May 1, 2002, the Texas Youth Commission 1-18 shall review the benefits of the potential use of the Children's 1-19 Medication Algorithm Project, as developed by the Texas Department 1-20 of Mental Health and Mental Retardation, to treat children with 1-21 mental illness in the custody of the commission. 1-22 (c) The Texas Council on Offenders with Mental Impairments, 1-23 in conjunction with the Criminal Justice Policy Council, shall 1-24 oversee the analysis conducted by the Texas Department of Criminal 1-25 Justice as required by Subsection (a) of this section and the 1-26 review conducted by the Texas Youth Commission as required by 1-27 Subsection (b) of this section and, not later than December 1, 1-28 2002, report to the legislature on the results of the analysis and 1-29 the review. 1-30 SECTION 2. This Act takes effect immediately if it receives 1-31 a vote of two-thirds of all the members elected to each house, as 1-32 provided by Section 39, Article III, Texas Constitution. If this 1-33 Act does not receive the vote necessary for immediate effect, this 1-34 Act takes effect September 1, 2001. 1-35 * * * * *
