                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the composition of the retirement board for the
 1-3     retirement systems for police officers in certain municipalities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Sections 3.02(a) and (b), Chapter 452, Acts of the
 1-6     72nd Legislature, Regular Session, 1991 (Article 6243n-1, Vernon's
 1-7     Texas Civil Statutes), are amended to read as follows:
 1-8           (a)  The police retirement board shall be composed of 13 [11]
 1-9     members as follows:
1-10                 (1)  one council member designated by the city council;
1-11                 (2)  the city manager or the city manager's designee;
1-12                 (3)  the director of finance or the director's
1-13     designee;
1-14                 (4)  five police officer members elected by the police
1-15     officer members of the system, each of whom serves for a term of
1-16     four years;
1-17                 (5)  one legally qualified voter of the city, resident
1-18     for the preceding five years, to be appointed by the police
1-19     retirement board to serve for a term of four years and until the
1-20     member's successor is duly selected and qualified; [and]
1-21                 (6)  three [two] retired members [to be] elected by the
1-22     retired members to serve for a term of four years; and
1-23                 (7)  one active police officer who is the president of
1-24     an association recognized under Subchapter I, Chapter 143, Local
 2-1     Government Code, as the sole and exclusive bargaining agent for all
 2-2     of the covered police officers of the city, or a person designated
 2-3     by that president[, with the term of one member expiring each
 2-4     odd-numbered year].
 2-5           (b)  The terms of two members elected as described by
 2-6     Subsection (a)(4) of this section expire in 2001 and every fourth
 2-7     subsequent year, and the terms of three members elected as
 2-8     described by Subsection (a)(4) of this section expire in 2003 and
 2-9     every fourth subsequent year.  The term of the person serving on
2-10     the board as provided by Subsection (a)(7) of this section begins
2-11     at the time of the first meeting of the board following the trustee
2-12     election in 2001.
2-13           SECTION 2. Section 3.03(j), Chapter 452, Acts of the 72nd
2-14     Legislature, Regular Session, 1991 (Article 6243n-1, Vernon's Texas
2-15     Civil Statutes), is amended to read as follows:
2-16           (j)  An election for retired members shall be held during the
2-17     first week in December of each odd-numbered year.  The terms of two
2-18     members serving on the board as provided by Section 3.02(a)(6) of
2-19     this Act begin at the first meeting of the board following the
2-20     trustee election in 2001 and expire in 2005 and every fourth
2-21     subsequent year.  The term of the other member serving on the board
2-22     as provided by Section 3.02(a)(6) of this Act expires in 2003 and
2-23     every fourth subsequent year.  When only one place on the board is
2-24     to be filled, the  [The] retired member receiving the highest
2-25     number of votes in an election is elected.  When two places on the
2-26     board are to be filled, the two retired members receiving the
2-27     highest and next highest number of votes in an election are
 3-1     elected. In case of a tie vote, selection shall be by lot.
 3-2           SECTION 3.  The retiree who is serving immediately before the
 3-3     effective date of this Act as a board member with a term expiring
 3-4     in 2003 may complete that term, notwithstanding amendments made by
 3-5     this Act to Section 3.03(j), Chapter 452, Acts of the 72nd
 3-6     Legislature, Regular Session, 1991 (Article 6243n-1, Vernon's Texas
 3-7     Civil Statutes).
 3-8           SECTION 4. This Act takes effect September 1, 2001.
