 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to certain entities and individuals permitted to exchange
1-11     information regarding special needs offenders.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Subdivision (1), Subsection (c), Section 614.017,
1-14     Health and Safety Code, is amended to read as follows:
1-15                 (1)  "Agency" includes any of the following entities
1-16     and individuals, a person with an agency relationship with one of
1-17     the following entities or individuals, and a person who contracts
1-18     with one or more of the following entities or individuals:
1-19                       (A)  the institutional division of the Texas
1-20     Department of Criminal Justice;
1-21                       (B)  the pardons and paroles division of the
1-22     Texas Department of Criminal Justice;
1-23                       (C)  the community justice assistance division of
1-24     the Texas Department of Criminal Justice;
1-25                       (D)  the state jail division of the Texas
1-26     Department of Criminal Justice;
1-27                       (E)  the Texas Department of Mental Health and
1-28     Mental Retardation;
1-29                       (F)  the Texas Juvenile Probation Commission;
1-30                       (G)  the Texas Youth Commission;
1-31                       (H)  the Texas Rehabilitation Commission;
1-32                       (I)  the Texas Education Agency;
1-33                       (J)  the Criminal Justice Policy Council;
1-34                       (K)  the Texas Commission on Alcohol and Drug
1-35     Abuse;
1-36                       (L)  the Commission on Jail Standards;
1-37                       (M)  the Texas Department of Human Services;
1-38                       (N)  the Texas Department on Aging;
1-39                       (O)  the Texas School for the Blind and Visually
1-40     Impaired;
1-41                       (P)  the Texas Department of Health;
1-42                       (Q)  the Texas Commission for the Deaf and Hard
1-43     of Hearing;
1-44                       (R)  community supervision and corrections
1-45     departments;
1-46                       (S)  personal bond pretrial release offices
1-47     established under Article 17.42, Code of Criminal Procedure; [and]
1-48                       (T)  local jails regulated by the Commission on
1-49     Jail Standards;
1-50                       (U)  a municipal or county health department;
1-51                       (V)  a hospital district;
1-52                       (W)  a judge of this state with jurisdiction over
1-53     criminal cases;
1-54                       (X)  an attorney who is appointed or retained to
1-55     represent a special needs offender; and
1-56                       (Y)  an attorney representing the state.
1-57           SECTION 2.  This Act takes effect immediately if it receives
1-58     a vote of two-thirds of all the members elected to each house, as
1-59     provided by Section 39, Article III, Texas Constitution.  If this
1-60     Act does not receive the vote necessary for immediate effect, this
1-61     Act takes effect September 1, 2001.
