                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the surrender of a suspended, canceled, revoked, or
 1-3     disqualified driver's license; providing a penalty.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 521.315, Transportation Code, is amended
 1-6     to read as follows:
 1-7           Sec. 521.315.  SURRENDER OF LICENSE; RETURN.  (a)  On the
 1-8     suspension, cancellation, disqualification, or revocation of a
 1-9     license by the department, the department may require the holder to
1-10     surrender the license to the department.
1-11           (b)  The department shall return a suspended license to the
1-12     holder on the expiration of the suspension period.
1-13           (c)  A person commits an offense if the person's license has
1-14     been demanded in accordance with Subsection (a) and the person
1-15     fails or refuses to surrender the license to the department.
1-16           (d)  An offense under this section is a Class B misdemeanor.
1-17           SECTION 2.  Section 521.451, Transportation Code, is amended
1-18     to read as follows:
1-19           Sec. 521.451.  GENERAL VIOLATION.  (a)  Except as provided by
1-20     Section 521.452, a person may not:
1-21                 (1)  display, cause or permit to be displayed, or have
1-22     in the person's possession a driver's license or certificate that
1-23     the person knows is fictitious or has been [canceled, revoked,
1-24     suspended, or] altered;
1-25                 (2)  lend the person's driver's license or certificate
 2-1     to another person or knowingly permit another person to use the
 2-2     person's driver's license or certificate;
 2-3                 (3)  display or represent as the person's own a
 2-4     driver's license or certificate not issued to the person;
 2-5                 (4)  [fail or refuse to surrender to the department on
 2-6     demand a driver's license or certificate that has been canceled,
 2-7     suspended, or revoked;]
 2-8                 [(5)]  possess more than one currently valid driver's
 2-9     license or more than one currently valid certificate; or
2-10                 (5) [(6)]  in an application for an original, renewal,
2-11     or duplicate driver's license or certificate:
2-12                       (A)  provide a false name, false address, or a
2-13     counterfeit document; or
2-14                       (B)  knowingly make a false statement, conceal a
2-15     material fact, or otherwise commit fraud.
2-16           (b)  An offense under this section is a Class B misdemeanor.
2-17           SECTION 3.  This Act takes effect September 1, 2001.
