A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the penalty for presenting or displaying a suspended,
1-3 canceled, revoked or denied driver license.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 521.315, Transportation Code, is amended to
1-6 read as follows:
1-7 Section 521.315, Surrender of License; Return
1-8 (a) On the suspension, cancellation, disqualification, or
1-9 revocation of a license by the department, the department may
1-10 require the holder to surrender the license to the department.
1-11 (b) The department shall return a suspended license to the holder
1-12 on the expiration of the suspension period.
1-13 (c) A person commits an offense if the person whose license has
1-14 been demanded under this subsection fails or refuses to surrender
1-15 to the department the suspended, cancelled or revoked driver
1-16 license.
1-17 (d) An offense under this subsection is a Class B misdemeanor.
1-18 SECTION 2. Sec. 521.451, Transportation Code, is amended to read
1-19 as follows:
1-20 Section 521.451. General Violation. (a) Except as provided by a
1-21 person may not:
1-22 (1) display, cause or permit to be displayed, or have in the
1-23 person's possession a driver's license or certificate that the
2-1 person knows is fictitious or has been [canceled, revoked,
2-2 suspended, or] altered;
2-3 (2) lend the person's driver's license or certificate to another
2-4 person or knowingly permit another person to use the person's
2-5 driver's license or certificate;
2-6 (3) display or represent as the person's own a driver's license or
2-7 certificate not issued to the person;
2-8 [(4) fail or refuse to surrender to the department on demand a
2-9 driver's license or certificate that has been canceled, suspended,
2-10 or revoked;]
2-11 [(5)] (4) possess more than one currently valid driver's license or
2-12 more than one currently valid certificate; or
2-13 [(6)] (5) in an application for an original, renewal, or duplicate
2-14 driver's license or certificate:
2-15 (A) provide a false name, false address, or a counterfeit
2-16 document; or
2-17 (B) knowingly make a false statement, conceal a material fact, or
2-18 otherwise commit fraud.
2-19 (b) An offense under this section is a Class B misdemeanor.
