 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the surrender of a suspended, canceled, revoked, or
1-11     disqualified driver's license; providing a penalty.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Section 521.315, Transportation Code, is amended
1-14     to read as follows:
1-15           Sec. 521.315.  SURRENDER OF LICENSE; RETURN.  (a)  On the
1-16     suspension, cancellation, disqualification, or revocation of a
1-17     license by the department, the department may require the holder to
1-18     surrender the license to the department.
1-19           (b)  The department shall return a suspended license to the
1-20     holder on the expiration of the suspension period.
1-21           (c)  A person commits an offense if the person's license has
1-22     been demanded in accordance with Subsection (a) and the person
1-23     fails or refuses to surrender the license to the department.
1-24           (d)  An offense under this section is a Class B misdemeanor.
1-25           SECTION 2.  Section 521.451, Transportation Code, is amended
1-26     to read as follows:
1-27           Sec. 521.451.  GENERAL VIOLATION.  (a)  Except as provided by
1-28     Section 521.452, a person may not:
1-29                 (1)  display, cause or permit to be displayed, or have
1-30     in the person's possession a driver's license or certificate that
1-31     the person knows is fictitious or has been [canceled, revoked,
1-32     suspended, or] altered;
1-33                 (2)  lend the person's driver's license or certificate
1-34     to another person or knowingly permit another person to use the
1-35     person's driver's license or certificate;
1-36                 (3)  display or represent as the person's own a
1-37     driver's license or certificate not issued to the person;
1-38                 (4)  [fail or refuse to surrender to the department on
1-39     demand a driver's license or certificate that has been canceled,
1-40     suspended, or revoked;]
1-41                 [(5)]  possess more than one currently valid driver's
1-42     license or more than one currently valid certificate; or
1-43                 (5) [(6)]  in an application for an original, renewal,
1-44     or duplicate driver's license or certificate:
1-45                       (A)  provide a false name, false address, or a
1-46     counterfeit document; or
1-47                       (B)  knowingly make a false statement, conceal a
1-48     material fact, or otherwise commit fraud.
1-49           (b)  An offense under this section is a Class B misdemeanor.
1-50           SECTION 3.  This Act takes effect September 1, 2001.
