                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the power of the Texas Natural Resource Conservation
 1-3     Commission to reopen air quality permits for review.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 382.0518, Health and Safety Code, is
 1-6     amended by adding subsection (i) to read as follows:
 1-7     (i)  The commission may, for good cause, amend any permit it issues
 1-8     under this chapter for reasons pertaining to public health or
 1-9     control of air pollution.  The commission may, in its discretion,
1-10     hold a contested case hearing regarding amendments under this
1-11     subsection at the request of the permittee or other interested
1-12     party.  The commission shall adopt rules prescribing requirements
1-13     for public notice and contested case hearing under this subsection.
1-14           SECTION 2.  The change made by this Act applies to all
1-15     existing permits, as well as those subsequently issued under this
1-16     section as amended.
1-17           SECTION 3.  This Act takes effect immediately if it receives
1-18     a vote of two-thirds of all the members elected to each house, as
1-19     provided by Section 39, Article III, Texas Constitution.  If this
1-20     Act does not receive the vote necessary for immediate effect, this
1-21     Act takes effect September 1, 2001.
