1-1                                   AN ACT
 1-2     relating to the confidentiality of credit card, debit card, charge
 1-3     card, and access device numbers that are collected, assembled, or
 1-4     maintained by a governmental body and of certain e-mail addresses.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Subchapter C, Chapter 552, Government Code, is
 1-7     amended by adding Sections 552.136 and 552.137 to read as follows:
 1-8           Sec. 552.136.  CONFIDENTIALITY OF CREDIT CARD, DEBIT CARD,
 1-9     CHARGE CARD, AND ACCESS DEVICE NUMBERS.  (a)  In this section,
1-10     "access device" means a card, plate, code, account number, personal
1-11     identification number, electronic serial number, mobile
1-12     identification number, or other telecommunications service,
1-13     equipment, or instrument identifier or means of account access that
1-14     alone or in conjunction with another access device may be used to:
1-15                 (1)  obtain money, goods, services, or another thing of
1-16     value; or
1-17                 (2)  initiate a transfer of funds other than a transfer
1-18     originated solely by paper instrument.
1-19           (b)  Notwithstanding any other provision of this chapter, a
1-20     credit card, debit card, charge card, or access device  number that
1-21     is collected, assembled, or maintained by or for a governmental
1-22     body is confidential.
1-23           Sec. 552.137.  CONFIDENTIALITY OF CERTAIN E-MAIL ADDRESSES.
1-24     (a)  An e-mail address of a member of the public that is provided
1-25     for the purpose of communicating electronically with a governmental
 2-1     body is confidential and not subject to disclosure under this
 2-2     chapter.
 2-3           (b)  Confidential information described by this section that
 2-4     relates to a member of the public may be disclosed if the member of
 2-5     the public affirmatively consents to its release.
 2-6           SECTION 2.  This Act takes effect immediately if it receives
 2-7     a vote of two-thirds of all the members elected to each house, as
 2-8     provided by Section 39, Article III, Texas Constitution.  If this
 2-9     Act does not receive the vote necessary for immediate effect, this
2-10     Act takes effect September 1, 2001.
