                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the confidentiality of credit card, debit card, and
 1-3     access device numbers that are collected, assembled, or maintained
 1-4     by a governmental body.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Subchapter C, Chapter 552, Government Code, is
 1-7     amended by adding Section 552.136 to read as follows:
 1-8           Sec. 552.136.  CONFIDENTIALITY OF CREDIT CARD, DEBIT CARD,
 1-9     AND ACCESS DEVICE NUMBERS.  (a)  In this section, "access device"
1-10     means a card, plate, code, account number, personal identification
1-11     number, electronic serial number, mobile identification number, or
1-12     other telecommunications service, equipment, or instrument
1-13     identifier or means of account access that alone or in conjunction
1-14     with another access device may be used to:
1-15                 (1)  obtain money, goods, services, or other thing of
1-16     value; or
1-17                 (2)  initiate a transfer of funds other than a transfer
1-18     originated solely by paper instrument.
1-19           (b)  Notwithstanding any other provision of this chapter, a
1-20     credit card, debit card, or access device  number that is
1-21     collected, assembled, or maintained by or for a governmental body
1-22     is confidential.
1-23           SECTION 2.  This Act takes effect immediately if it receives
1-24     a vote of two-thirds of all the members elected to each house, as
 2-1     provided by Section 39, Article III, Texas Constitution.  If this
 2-2     Act does not receive the vote necessary for immediate effect, this
 2-3     Act takes effect September 1, 2001.
