No. 694 1-2 (In the Senate - Filed February 14, 2001; February 15, 2001, 1-3 read first time and referred to Committee on State Affairs; 1-4 March 14, 2001, reported favorably by the following vote: Yeas 8, 1-5 Nays 0; March 14, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the confidentiality of credit card, debit card, and 1-9 access device numbers that are collected, assembled, or maintained 1-10 by a governmental body. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Subchapter C, Chapter 552, Government Code, is 1-13 amended by adding Section 552.136 to read as follows: 1-14 Sec. 552.136. CONFIDENTIALITY OF CREDIT CARD, DEBIT CARD, 1-15 AND ACCESS DEVICE NUMBERS. (a) In this section, "access device" 1-16 means a card, plate, code, account number, personal identification 1-17 number, electronic serial number, mobile identification number, or 1-18 other telecommunications service, equipment, or instrument 1-19 identifier or means of account access that alone or in conjunction 1-20 with another access device may be used to: 1-21 (1) obtain money, goods, services, or other thing of 1-22 value; or 1-23 (2) initiate a transfer of funds other than a transfer 1-24 originated solely by paper instrument. 1-25 (b) Notwithstanding any other provision of this chapter, a 1-26 credit card, debit card, or access device number that is 1-27 collected, assembled, or maintained by or for a governmental body 1-28 is confidential. 1-29 SECTION 2. This Act takes effect immediately if it receives 1-30 a vote of two-thirds of all the members elected to each house, as 1-31 provided by Section 39, Article III, Texas Constitution. If this 1-32 Act does not receive the vote necessary for immediate effect, this 1-33 Act takes effect September 1, 2001. 1-34 * * * * *
