                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to membership of the board of directors of the Lubbock
 1-3     Reese Development Authority.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 396.003, Local Government Code, is amended
 1-6     to read as follows:
 1-7           Sec. 396.003.  BOARD. (a)  The board consists of nine members
 1-8     and is responsible for the management, operation, and control of
 1-9     the authority.
1-10           (b)  The board is composed of:
1-11                 (1)  seven [two] members appointed by the governing
1-12     body of the municipality;
1-13                 (2)  one member [two members] appointed by the
1-14     governing body of the county; and
1-15                 (3)  one member appointed by the South Plains
1-16     Association of Governments[; and]
1-17                 [(4)  four at-large members appointed by the majority
1-18     vote of the members appointed under Subdivisions (1), (2), and
1-19     (3)].
1-20           (c)  A vacancy on the board is filled in the same manner as
1-21     the original appointment.  [In order to implement staggered terms
1-22     of office, beginning on October 1, 1999, at the expiration of the
1-23     terms of office of the initial board, successor members shall be
1-24     appointed to serve as follows:]
 2-1                 [(1)  one of the two members appointed by the governing
 2-2     body of the municipality shall be appointed to serve a term of two
 2-3     years, and the remaining member shall be appointed to serve a term
 2-4     of four years;]
 2-5                 [(2)  one of the two members appointed by the governing
 2-6     body of the county shall be appointed to serve a term of two years,
 2-7     and the remaining member shall be appointed to serve a term of four
 2-8     years;]
 2-9                 [(3)  the member appointed by the South Plains
2-10     Association of Governments shall be appointed to serve a term of
2-11     two years; and]
2-12                 [(4)  two of the four at-large members appointed by the
2-13     majority vote of the members appointed under Subsections (b)(1),
2-14     (2), and (3) shall be appointed to serve a term of two years, and
2-15     the remaining two members shall be appointed to serve a term of
2-16     four years.]
2-17           (d)  All [(e)  At the expiration of the two-year and
2-18     four-year terms of office provided for under Subsections
2-19     (d)(1)-(4), all following] terms of office shall be for a period of
2-20     four years.  A member appointed to fill a vacancy for an unexpired
2-21     term shall serve for the remainder of that term only. A member may
2-22     be appointed to succeed himself or herself on the board for only
2-23     one additional successive term.
2-24           (e) [(f)]  The members of the board shall elect from its
2-25     membership a president and a vice president.  The vice president
2-26     shall preside in the absence of the president.
2-27           (f) [(g)]  The board shall adopt rules for its proceedings
 3-1     and may employ and compensate persons to carry out the powers and
 3-2     duties of the authority.
 3-3           SECTION 2. The members of the board of directors of the
 3-4     Lubbock Reese Development Authority serving on the effective date
 3-5     of this Act continue to serve on the board for the remainder of
 3-6     their terms. Beginning on October 1, 2001, as members' terms expire
 3-7     or as vacancies occur on the board of directors, successor members
 3-8     shall be appointed as follows:
 3-9                 (1)  the first available position shall be filled by
3-10     the governing body of the county;
3-11                 (2)  the second available position shall be filled by
3-12     the South Plains Association of Governments; and
3-13                 (3)  the other positions, as they become available,
3-14     shall be filled by the governing body of the municipality.
3-15           SECTION 3.  This Act takes effect immediately if it receives
3-16     a vote of two-thirds of all the members elected to each house, as
3-17     provided by Section 39, Article III, Texas Constitution.  If this
3-18     Act does not receive the vote necessary for immediate effect, this
3-19     Act takes effect September 1, 2001.
