 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to membership of the board of directors of the Lubbock
1-11     Reese Redevelopment Authority.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Section 396.003, Local Government Code, is
1-14     amended to read as follows:
1-15           Sec. 396.003.  BOARD.  (a)  The board consists of nine
1-16     members and is responsible for the management, operation, and
1-17     control of the authority.
1-18           (b)  The board is composed of:
1-19                 (1)  seven [two] members appointed by the governing
1-20     body of the municipality;
1-21                 (2)  one member [two members] appointed by the
1-22     governing body of the county; and
1-23                 (3)  one member appointed by the South Plains
1-24     Association of Governments[; and]
1-25                 [(4)  four at-large members appointed by the majority
1-26     vote of the members appointed under Subdivisions (1), (2), and
1-27     (3)].
1-28           (c)  A vacancy on the board is filled in the same manner as
1-29     the original appointment[.  In order to implement staggered terms
1-30     of office, beginning on October 1, 1999, at the expiration of the
1-31     terms of office of the initial board, successor members shall be
1-32     appointed to serve as follows:]
1-33                 [(1)  one of the two members appointed by the governing
1-34     body of the municipality shall be appointed to serve a term of two
1-35     years, and the remaining member shall be appointed to serve a term
1-36     of four years;]
1-37                 [(2)  one of the two members appointed by the governing
1-38     body of the county shall be appointed to serve a term of two years,
1-39     and the remaining member shall be appointed to serve a term of four
1-40     years;]
1-41                 [(3)  the member appointed by the South Plains
1-42     Association of Governments shall be appointed to serve a term of
1-43     two years; and]
1-44                 [(4)  two of the four at-large members appointed by the
1-45     majority vote of the members appointed under Subsections (b)(1),
1-46     (2), and (3) shall be appointed to serve a term of two years, and
1-47     the remaining two members shall be appointed to serve a term of
1-48     four years].
1-49           (d)  All [(e)  At the expiration of the two-year and
1-50     four-year terms of office provided for under Subsections
1-51     (d)(1)-(4), all following] terms of office shall be for a period of
1-52     four years.  A member appointed to fill a vacancy for an unexpired
1-53     term shall serve for the remainder of that term only.  A member may
1-54     be appointed to succeed himself or herself on the board for only
1-55     one additional successive term.
1-56           (e) [(f)]  The members of the board shall elect from its
1-57     membership a president and a vice president.  The vice president
1-58     shall preside in the absence of the president.
1-59           (f) [(g)]  The board shall adopt rules for its proceedings
1-60     and may employ and compensate persons to carry out the powers and
1-61     duties of the authority.
1-62           SECTION 2.  The members of the board of directors of the
1-63     Lubbock Reese Redevelopment Authority serving on the effective date
1-64     of this Act continue to serve on the board for the remainder of
 2-1     their terms.  For members' terms that begin on October 1, 2001,
 2-2     appointments shall be made as follows:
 2-3                 (1)  one position shall be filled by the South Plains
 2-4     Association of Governments; and
 2-5                 (2)  the other positions shall be filled by the
 2-6     governing body of the municipality.
 2-7           SECTION 3.  This Act takes effect immediately if it receives
 2-8     a vote of two-thirds of all the members elected to each house, as
 2-9     provided by Section 39, Article III, Texas Constitution.  If this
2-10     Act does not receive the vote necessary for immediate effect, this
2-11     Act takes effect September 1, 2001.
