 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the establishment and operation of the San Antonio Life
1-11     Sciences Institute in The University of Texas System.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Chapter 75, Education Code, is amended by adding
1-14     Subchapter C to read as follows:
1-15             SUBCHAPTER C.  SAN ANTONIO LIFE SCIENCES INSTITUTE
1-16           Sec. 75.201.  DEFINITIONS.  In this subchapter:
1-17                 (1)  "Board" means the board of regents of The
1-18     University of Texas System.
1-19                 (2)  "Health science center" means The University of
1-20     Texas Health Science Center at San Antonio.
1-21                 (3)  "Institute" means the San Antonio Life Sciences
1-22     Institute.
1-23                 (4)  "University" means The University of Texas at San
1-24     Antonio.
1-25           Sec. 75.202.  ESTABLISHMENT.  The board may establish and
1-26     maintain the San Antonio Life Sciences Institute as a joint
1-27     partnership of the health science center and the university.
1-28           Sec. 75.203.  ROLE AND SCOPE.  (a)  The institute shall
1-29     specialize in research and teaching in the life sciences.
1-30           (b)  The institute shall develop joint degree programs and
1-31     joint research programs for the health science center and the
1-32     university.
1-33           (c)  The institute may accept gifts, grants, and donations
1-34     from any source for the purposes of the program.  The institute may
1-35     develop or use land, buildings, equipment, facilities, and other
1-36     improvements in connection with the program.  To the extent that
1-37     any funds are appropriated in the General Appropriations Act by the
1-38     77th Legislature, the institute may accept any amount authorized.
1-39           (d)  The institute shall seek private, local and federal
1-40     funding to support the operation and management of the institute.
1-41           Sec. 75.204.  OPERATION AND MANAGEMENT.  (a)  The
1-42     administration of the institute is under the direction of the
1-43     chancellor of The University of Texas System and the board through
1-44     the presidents of the health science center and the university.
1-45           (b)  The costs of the operation and management of the
1-46     institute may be paid from money appropriated for that purpose and
1-47     from other money from any public or private source.  The institute
1-48     shall retain all indirect costs received or recovered under a grant
1-49     or contract.
1-50           (c)  The board may make joint appointments of faculty or
1-51     other personnel to the institute and to either or both the health
1-52     science center and the university.  The salary of a person
1-53     receiving a joint appointment shall be apportioned on the basis of
1-54     services rendered.
1-55           (d)  The institute shall be located in facilities determined
1-56     appropriate by the board.
1-57           SECTION 2.  This Act takes effect September 1, 2001.
