1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to authorizing members of the governing body of certain
1-11 municipalities to serve as volunteers.
1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13 SECTION 1. The heading to Chapter 21, Local Government Code,
1-14 is amended to read as follows:
1-15 CHAPTER 21. GENERAL PROVISIONS AFFECTING GOVERNING BODY OF
1-16 [GENERAL-LAW] MUNICIPALITY
1-17 SECTION 2. Subchapter A, Chapter 21, Local Government Code,
1-18 is amended by adding Section 21.002 to read as follows:
1-19 Sec. 21.002. MEMBERS OF CERTAIN MUNICIPAL GOVERNING BODIES
1-20 MAY VOLUNTEER. (a) This section applies only to a municipality
1-21 with a population of less than 10,000.
1-22 (b) A member of the governing body of a municipality may
1-23 serve as a volunteer for an organization that protects the health,
1-24 safety, or welfare of the municipality regardless of whether the
1-25 organization is funded or supported in whole or part by the
1-26 municipality if the governing body adopts a resolution allowing
1-27 members of the governing body to perform service of that nature.
1-28 SECTION 3. This Act takes effect immediately if it receives
1-29 a vote of two-thirds of all the members elected to each house, as
1-30 provided by Section 39, Article III, Texas Constitution. If this
1-31 Act does not receive the vote necessary for immediate effect, this
1-32 Act takes effect September 1, 2001.
