                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to standardized training in the use and application of
 1-3     certain pesticides.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 76.101, Agriculture Code, is amended by
 1-6     adding Subsection (e) to read as follows:
 1-7           (e)  In carrying out its duties under Subsections (a) and
 1-8     (b), the department by rule shall develop and approve a
 1-9     standardized training program for the application of pesticides by
1-10     commercial, noncommercial, and private applicators for the control
1-11     of mosquitoes and the prevention of mosquito-borne diseases that
1-12     includes instruction on:
1-13                 (1)  common types of mosquitoes and the diseases
1-14     associated with each type; and
1-15                 (2)  proper choice and application of pesticides for
1-16     each type of mosquito.
1-17           SECTION 2.  This Act takes effect immediately if it receives
1-18     a vote of two-thirds of all the members elected to each house, as
1-19     provided by Section 39, Article III, Texas Constitution.  If this
1-20     Act does not receive the vote necessary for immediate effect, this
1-21     Act takes effect September 1, 2001.
