                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the composition of the Texas Alcoholic Beverage
 1-3     Commission.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 5.02, Alcoholic Beverage Code, is amended
 1-6     by amending Subsections (a) and (c) and adding Subsection (e) to
 1-7     read as  follows:
 1-8           (a)  The commission is composed of six [three] members, who
 1-9     are appointed by the governor with the advice and consent of the
1-10     senate.
1-11           (c)  Appointments to the commission shall be made without
1-12     regard to the race, color, handicap, sex, religion, age, or
1-13     national origin of the appointees and shall reflect the diversity
1-14     of the population of the state as a whole.
1-15           (e)  Appointments to the commission shall be made so that
1-16     each geographic area of the state is represented on the commission.
1-17           SECTION 2.  Section 5.03, Alcoholic Beverage Code, is amended
1-18     to read as follows:
1-19           Sec. 5.03.  TERMS OF OFFICE.  The members of the commission
1-20     hold office for staggered terms of six years, with the terms [term]
1-21     of two members [one member] expiring every two years.  Each member
1-22     holds office until his successor is appointed and has qualified.  A
1-23     member may be appointed to succeed himself.
1-24           SECTION 3.  As soon as possible after the effective date of
1-25     this Act, the governor shall appoint three additional members to
 2-1     the Texas Alcoholic Beverage Commission to comply with Section
 2-2     5.02, Alcoholic Beverage Code, as amended by this Act.  In
 2-3     appointing those members, the governor shall appoint one person to
 2-4     a term expiring November 15, 2003, one person to a term expiring
 2-5     November 15, 2005, and one person to a term expiring November 15,
 2-6     2007.
 2-7           SECTION 4.  This Act takes effect September 1, 2001.
