                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the composition of the Texas Alcoholic Beverage
 1-3     Commission.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Sections 5.02(a) and (c), Alcoholic Beverage
 1-6     Code, are amended to read as follows:
 1-7           (a)  The commission is composed of six [three] members, who
 1-8     are appointed by the governor with the advice and consent of the
 1-9     senate.
1-10           (c)  Appointments to the commission shall be made without
1-11     regard to the race, color, handicap, sex, religion, age, or
1-12     national origin of the appointees.  In making appointments to the
1-13     commission, the governor shall attempt to reflect the geographic
1-14     diversity of the state.
1-15           SECTION 2.  Section 5.03, Alcoholic Beverage Code, is amended
1-16     to read as follows:
1-17           Sec. 5.03.  TERMS OF OFFICE.  The members of the commission
1-18     hold office for staggered terms of six years, with the terms [term]
1-19     of two members [one member] expiring every two years.  Each member
1-20     holds office until his successor is appointed and has qualified.  A
1-21     member may be appointed to succeed himself.
1-22           SECTION 3.  (a)  This Act takes effect September 1, 2001.
1-23           (b)  Until all appointees have taken office, a quorum of the
1-24     Texas Alcoholic Beverage Commission is a majority of the number of
 2-1     members who are qualified.
