No. 810 77R4095 SGA-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to a moratorium on the regulation of shrimping by the 1-3 Parks and Wildlife Department. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. RULES RELATED TO SHRIMPING. (a) On the 1-6 effective date of this Act, all rules adopted and proclamations 1-7 issued by the Parks and Wildlife Commission on or after July 1, 1-8 2000, that relate to the regulation of the shrimping industry along 1-9 the Texas Gulf Coast and in the Gulf of Mexico are repealed. 1-10 (b) On the effective date of this Act, the Parks and 1-11 Wildlife Commission shall adopt the rules and proclamations 1-12 relating to the regulation of the shrimping industry that were in 1-13 effect on June 30, 2000, as emergency rules for the regulation of 1-14 the shrimping industry. Before the emergency rules expire, the 1-15 commission shall adopt those rules as the rules relating to the 1-16 regulation of the shrimping industry. 1-17 (c) The Parks and Wildlife Commission may not adopt any new 1-18 rules, issue new proclamations, or amend existing regulations that 1-19 relate to the shrimping industry except as authorized by the 1-20 legislature or as required for compliance with federal law. 1-21 SECTION 2. ECONOMIC IMPACT ANALYSIS. The Parks and Wildlife 1-22 Department shall conduct a comprehensive economic impact analysis 1-23 of all current state and federal regulations on the shrimping 1-24 industry. The analysis must include input from representatives of 2-1 the shrimping industry and all other interested persons. The 2-2 analysis must estimate the economic impact that regulations passed 2-3 on or after July 1, 2000, would have had if those regulations had 2-4 remained in effect after the effective date of this Act. The Parks 2-5 and Wildlife Commission shall deliver the analysis to the 2-6 legislature, the lieutenant governor, and the governor on or before 2-7 September 1, 2002. 2-8 SECTION 3. STUDY OF SHRIMPING INDUSTRY. The Parks and 2-9 Wildlife Department shall prepare a comprehensive study of the 2-10 economic and biological health of the shrimping industry. The 2-11 study must include input from representatives of the shrimping 2-12 industry and all other interested persons. The Parks and Wildlife 2-13 Commission shall deliver the report to the legislature, the 2-14 lieutenant governor, and the governor on or before September 1, 2-15 2002. 2-16 SECTION 4. EFFECTIVE DATE. This Act takes effect 2-17 immediately if it receives a vote of two-thirds of all the members 2-18 elected to each house, as provided by Section 39, Article III, 2-19 Texas Constitution. If this Act does not receive the vote 2-20 necessary for immediate effect, this Act takes effect September 1, 2-21 2001.
