No. 812 By: Carona 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to establishing a demonstration project to expand access 1-11 to women's health care services. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Subchapter B, Chapter 32, Human Resources Code, 1-14 is amended by adding Section 32.0247 to read as follows: 1-15 Sec. 32.0247. DEMONSTRATION PROJECT FOR WOMEN'S HEALTH CARE 1-16 SERVICES. (a) The department shall establish a five-year 1-17 demonstration project through the medical assistance program to 1-18 expand access to preventive health and family planning services for 1-19 women. A woman eligible under Subsection (b) to participate in the 1-20 demonstration project may receive preventive health and family 1-21 planning services including: 1-22 (1) medical history; 1-23 (2) physical examinations; 1-24 (3) counseling and education on contraceptive methods; 1-25 (4) provision of contraceptives; 1-26 (5) health screenings, including screening for: 1-27 (A) diabetes; 1-28 (B) cervical cancer; 1-29 (C) breast cancer; 1-30 (D) sexually transmitted diseases; 1-31 (E) hypertension; 1-32 (F) cholesterol; and 1-33 (G) tuberculosis; 1-34 (6) risk assessment; and 1-35 (7) referral of medical problems to appropriate 1-36 providers. 1-37 (b) A woman is eligible to participate in the demonstration 1-38 project if the woman: 1-39 (1) is of childbearing age, as determined by the 1-40 department; 1-41 (2) has a net family income that is at or below 185 1-42 percent of the federal poverty level; and 1-43 (3) is not otherwise eligible for the medical 1-44 assistance program. 1-45 (c) The department shall develop procedures for determining 1-46 and certifying presumptive eligibility for a woman eligible under 1-47 Subsection (b). The department shall integrate these procedures 1-48 with current procedures to minimize duplication of effort by 1-49 providers, the department, and other state agencies. 1-50 (d) The department shall provide for continuous eligibility 1-51 for a woman eligible under Subsection (b) for the duration of the 1-52 demonstration project. 1-53 (e) The department shall compile a list of potential funding 1-54 sources a client can use to help pay for treatment for health 1-55 problems: 1-56 (1) identified using services provided to the client 1-57 under the demonstration project; and 1-58 (2) for which the client is not eligible to receive 1-59 treatment under the medical assistance program. 1-60 (f) Not later than December 1 of each even-numbered year, 1-61 the department shall submit a report to the legislature regarding 1-62 the department's progress in establishing and operating the 1-63 demonstration project. 1-64 (g) This section expires September 1, 2006. 2-1 SECTION 2. The state agency responsible for implementing the 2-2 demonstration project required by Section 32.0247, Human Resources 2-3 Code, as added by this Act, shall request and actively pursue any 2-4 necessary waivers or authorizations from the Health Care Financing 2-5 Administration or other appropriate entities to enable the agency 2-6 to implement the demonstration project not later than September 1, 2-7 2002. The agency may delay implementing the demonstration project 2-8 until the necessary waivers or authorizations are granted. 2-9 SECTION 3. This Act takes effect immediately if it receives 2-10 a vote of two-thirds of all the members elected to each house, as 2-11 provided by Section 39, Article III, Texas Constitution. If this 2-12 Act does not receive the vote necessary for immediate effect, this 2-13 Act takes effect September 1, 2001. 2-14 * * * * *
