 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to regulation of the carrying of a handgun.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1.  Subsection (a), Section 30.06, Penal Code, is
1-11     amended to read as follows:
1-12           (a)  A license holder commits an offense if the license
1-13     holder:
1-14                 (1)  carries a handgun under the authority of
1-15     Subchapter H, Chapter 411, Government Code, on property, other than
1-16     government property, of another without effective consent; and
1-17                 (2)  received notice that:
1-18                       (A)  entry on the property by a license holder
1-19     with a concealed handgun was forbidden; or
1-20                       (B)  remaining on the property with a concealed
1-21     handgun was forbidden and failed to depart.
1-22           SECTION 2.  Subchapter H, Chapter 411, Government Code, is
1-23     amended by adding Section 411.209 to read as follows:
1-24           Sec. 411.209.  EXCLUSIVE REGULATORY AUTHORITY.  Except as
1-25     otherwise provided by federal law, the legislature has the
1-26     exclusive authority to regulate the carrying of a handgun.
1-27           SECTION 3.  (a)  The change in law made by this Act applies
1-28     only to an offense committed on or after the effective date of this
1-29     Act.  For purposes of this section, an offense is committed before
1-30     the effective date of this Act if any element of the offense occurs
1-31     before the effective date.
1-32           (b)  An offense committed before the effective date of this
1-33     Act is covered by the law in effect when the offense was committed,
1-34     and the former law is continued in effect for that purpose.
1-35           SECTION 4.  This Act takes effect September 1, 2001.
