1-1                                   AN ACT
 1-2     relating to the location of public education schools, programs, and
 1-3     classes.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter D,  Chapter 11, Education Code, is
 1-6     amended by adding Sections 11.166 and 11.167 to read as follows:
 1-7           Sec. 11.166.  OPERATION ON CAMPUS OF INSTITUTION OF HIGHER
 1-8     EDUCATION.  (a)  The board of trustees of a school district may
 1-9     operate a school or program or hold a class on the campus of an
1-10     institution of higher education in this state if the board obtains
1-11     written consent from the president or other chief executive officer
1-12     of the institution.
1-13           (b)  The president or other chief executive officer of an
1-14     institution of higher education may provide written consent to a
1-15     board of trustees of a school district under Subsection (a)
1-16     regardless of whether the institution is located within the
1-17     boundaries of the district.
1-18           Sec. 11.167.  OPERATION OUTSIDE DISTRICT BOUNDARIES.  The
1-19     board of trustees of a school district may operate a school or
1-20     program, including an extracurricular program, or hold a class
1-21     outside the boundaries of the district.
1-22           SECTION 2.  This Act takes effect immediately if it receives
1-23     a vote of two-thirds of all the members elected to each house, as
1-24     provided by Section 39, Article III, Texas Constitution.  If this
1-25     Act does not receive the vote necessary for immediate effect, this
