                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the location of public education programs.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Chapter 11, Subchapter D, Education Code is
 1-5     amended by adding a new Section 11.166 to read as follows:
 1-6           Sec. 11.166.  (a)  The board of trustees of an independent
 1-7     school district may operate a school, program, or hold classes on
 1-8     the campus of any college, university, or community college in this
 1-9     state.
1-10           (b)  Prior to operating a school, program, or holding classes
1-11     under Subsection (a), the board of trustees must obtain written
1-12     permission from President of the college, university, or community
1-13     college where the program or classes will be held.
1-14           (c)  A university may grant consent under Subsection (b) to
1-15     any school district.  Such consent is not limited to those
1-16     districts whose geographical boundaries encompass the location of
1-17     the college, university, or community college where the program or
1-18     classes are held.
1-19           SECTION 2.  This Act takes effect immediately if it receives
1-20     a vote of two-thirds of all the members elected to each house, as
1-21     provided by Section 39, Article III, Texas Constitution.  If this
1-22     Act does not receive the vote necessary for immediate effect, this
1-23     Act takes effect September 1, 2001.
