                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the continuation of and to the grant-making authority
 1-3     of the On-site Wastewater Treatment Research Council.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 367.003(a), Health and Safety Code, is
 1-6     amended to read as follows:
 1-7           (a)  The council is subject to Chapter 325, Government Code
 1-8     (Texas Sunset Act).  Unless continued in existence as provided by
 1-9     that chapter, the council is abolished and this chapter expires
1-10     September 1, 2005 [2001].
1-11           SECTION 2. Chapter 367, Health and Safety Code, is amended by
1-12     adding Section 367.0085 to read as follows:
1-13           Sec. 367.0085.  SMALL COMMUNITY GRANTS. (a)  The council may
1-14     award competitive grants under Section 367.008(b) for applied
1-15     research and demonstration projects described by that section that
1-16     include the improvement or provision of on-site wastewater
1-17     treatment at more than one residential site.
1-18           (b)  A grant authorized by this section is available only for
1-19     a project located in an incorporated or unincorporated area  in
1-20     which:
1-21                 (1)  there are not more than 100 residential lots; and
1-22                 (2)  those residential lots are being served by failing
1-23     on-site wastewater treatment systems.
1-24           (c)  The council by rule shall adopt eligibility requirements
 2-1     for grants authorized by this section, including the maximum number
 2-2     of residential sites that may be included in a project.
 2-3           SECTION 3. This Act takes effect September 1, 2001.
