 1-7     Amend S.B. No 828 by striking SECTION 1 of the bill and
 1-8     substituting the following:
 1-9           SECTION 1.  Subsection (a), Section 367.003, Health and
1-10     Safety Code, is amended to read as follows:
1-11           (a)  The On-site Wastewater Treatment Research Council is
1-12     subject to Chapter 325, Government Code (Texas Sunset Act).  Unless
1-13     continued in existence as provided by that chapter, the council is
1-14     abolished and this chapter expires September 1, 2003 [2001].
1-15                            A BILL TO BE ENTITLED
1-16                                   AN ACT
1-17     relating to the continuation of and to the grant-making authority
1-18     of the On-site Wastewater Treatment Research Council.
1-19           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-20           SECTION 1.  Subsection (a), Section 367.003, Health and
1-21     Safety Code, is amended to read as follows:
1-22           (a)  The council is abolished and this chapter expires
1-23     September 1, 2009 [2001].
1-24           SECTION 2.  Chapter 367, Health and Safety Code, is amended
1-25     by adding Section 367.0085 to read as follows:
1-26           Sec. 367.0085.  SMALL COMMUNITY GRANTS.  (a)  The council may
1-27     award competitive grants under Section 367.008(b) for applied
1-28     research and demonstration projects described by that section that
1-29     include the improvement or provision of on-site wastewater
1-30     treatment at more than one residential site.
1-31           (b)  A grant authorized by this section is available only for
1-32     a project located in an incorporated or unincorporated area  in
1-33     which:
1-34                 (1)  there are not more than 100 residential lots; and
1-35                 (2)  those residential lots are being served by failing
1-36     on-site wastewater treatment systems.
1-37           (c)  The council by rule shall adopt eligibility requirements
1-38     for grants authorized by this section, including the maximum number
1-39     of residential sites that may be included in a project.
1-40           SECTION 3.  This Act takes effect September 1, 2001.
