                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to requiring reports from the Health and Human Services
 1-3     Commission about the state Medicaid program.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter B, Chapter 531, Government Code, is
 1-6     amended by adding Sections 531.02111 and 531.02112 to read as
 1-7     follows:
 1-8           Sec. 531.02111.  BIENNIAL MEDICAID FINANCIAL REPORT.
 1-9     (a)  The commission shall prepare a biennial Medicaid financial
1-10     report covering each state agency that administers any part of the
1-11     state Medicaid program and each of the Medicaid programs operated
1-12     or administered by those agencies.
1-13           (b)  The report must include:
1-14                 (1)  for each state agency described by Subsection (a):
1-15                       (A)  a description of each of the Medicaid
1-16     programs administered or operated by the agency; and
1-17                       (B)  an accounting of all funds related to the
1-18     state Medicaid program received and disbursed by the agency during
1-19     the period covered by the report, including:
1-20                             (i)  the amount of any federal medical
1-21     assistance funds allocated to the agency for the support of  each
1-22     of the Medicaid programs operated or administered by the agency;
1-23                             (ii)  the amount of any funds appropriated
1-24     by the legislature to the agency for each of those programs; and
1-25                             (iii)  the amount of medical assistance
 2-1     payments and related expenditures made by or in connection with
 2-2     each of those programs; and
 2-3                 (2)  for each Medicaid program identified in the
 2-4     report:
 2-5                       (A)  the amount and source of funds or other
 2-6     revenue received by or made available to the agency for the
 2-7     program; and
 2-8                       (B)  the information required by Section
 2-9     531.02112(b).
2-10           (c)  The report must cover the three-year period ending on
2-11     the last day of the previous fiscal year.
2-12           (d)  The commission may request from any appropriate state
2-13     agency information necessary to complete the report.  Each agency
2-14     shall cooperate with the commission in providing information for
2-15     the report.
2-16           (e)  Not later than December 1 of each even-numbered year,
2-17     the commission shall submit the report to the governor, the
2-18     lieutenant governor, the speaker of the house of representatives,
2-19     the presiding officer of each standing committee of the senate and
2-20     house of representatives having jurisdiction over health and human
2-21     services issues, and the comptroller.
2-22           Sec. 531.02112.  QUARTERLY REPORT OF MEDICAID EXPENDITURES.
2-23     (a)  The commission shall prepare a report, on a quarterly basis,
2-24     regarding the Medicaid expenditures of each state agency that
2-25     administers or operates a Medicaid program.
2-26           (b)  The report must identify each agency's expenditures by
 3-1     Medicaid program and must include for each program:
 3-2                 (1)  the amount spent on each type of service or
 3-3     benefit provided by or under the program;
 3-4                 (2)  the amount spent on program operations, including
 3-5     eligibility determination, claims processing, and case management;
 3-6     and
 3-7                 (3)  the amount spent on any other administrative
 3-8     costs.
 3-9           (c)  The commission shall submit the report to the governor,
3-10     legislature, and comptroller.
3-11           SECTION 2.  This Act takes effect immediately if it receives
3-12     a vote of two-thirds of all the members elected to each house, as
3-13     provided by Section 39, Article III, Texas Constitution.  If this
3-14     Act does not receive the vote necessary for immediate effect, this
3-15     Act takes effect September 1, 2001.

3-17           SECTION 1.  Amend S.B. 832 by inserting "the state auditor,"
3-18     between the "," and the word "and" on page 2, line 21 of the bill.
3-19           SECTION 2.  Amend S.B. 832 by inserting "the state auditor,"
3-20     between the "," and the word "and" on page 3, line 10 of the bill.
