 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to requiring reports from the Health and Human Services
 1-9     Commission about the state Medicaid program.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subchapter B, Chapter 531, Government Code, is
1-12     amended by adding Sections 531.02111 and 531.02112 to read as
1-13     follows:
1-14           Sec. 531.02111.  BIENNIAL MEDICAID FINANCIAL REPORT.
1-15     (a)  The commission shall prepare a biennial Medicaid financial
1-16     report covering each state agency that administers any part of the
1-17     state Medicaid program and each of the Medicaid programs operated
1-18     or administered by those agencies.
1-19           (b)  The report must include:
1-20                 (1)  for each state agency described by Subsection (a):
1-21                       (A)  a description of each of the Medicaid
1-22     programs administered or operated by the agency; and
1-23                       (B)  an accounting of all funds related to the
1-24     state Medicaid program received and disbursed by the agency during
1-25     the period covered by the report, including:
1-26                             (i)  the amount of any federal medical
1-27     assistance funds allocated to the agency for the support of  each
1-28     of the Medicaid programs operated or administered by the agency;
1-29                             (ii)  the amount of any funds appropriated
1-30     by the legislature to the agency for each of those programs; and
1-31                             (iii)  the amount of medical assistance
1-32     payments and related expenditures made by or in connection with
1-33     each of those programs; and
1-34                 (2)  for each Medicaid program identified in the
1-35     report:
1-36                       (A)  the amount and source of funds or other
1-37     revenue received by or made available to the agency for the
1-38     program; and
1-39                       (B)  the information required by Section
1-40     531.02112(b).
1-41           (c)  The report must cover the three-year period ending on
1-42     the last day of the previous fiscal year.
1-43           (d)  The commission may request from any appropriate state
1-44     agency information necessary to complete the report.  Each agency
1-45     shall cooperate with the commission in providing information for
1-46     the report.
1-47           (e)  Not later than December 1 of each even-numbered year,
1-48     the commission shall submit the report to the governor, the
1-49     lieutenant governor, the speaker of the house of representatives,
1-50     the presiding officer of each standing committee of the senate and
1-51     house of representatives having jurisdiction over health and human
1-52     services issues, and the comptroller.
1-53           Sec. 531.02112.  QUARTERLY REPORT OF MEDICAID EXPENDITURES.
1-54     (a)  The commission shall prepare a report, on a quarterly basis,
1-55     regarding the Medicaid expenditures of each state agency that
1-56     administers or operates a Medicaid program.
1-57           (b)  The report must identify each agency's expenditures by
1-58     Medicaid program and must include for each program:
1-59                 (1)  the amount spent on each type of service or
1-60     benefit provided by or under the program;
1-61                 (2)  the amount spent on program operations, including
1-62     eligibility determination, claims processing, and case management;
1-63     and
1-64                 (3)  the amount spent on any other administrative
 2-1     costs.
 2-2           (c)  The commission shall submit the report to the governor,
 2-3     legislature, and comptroller.
 2-4           SECTION 2.  This Act takes effect immediately if it receives
 2-5     a vote of two-thirds of all the members elected to each house, as
 2-6     provided by Section 39, Article III, Texas Constitution.  If this
 2-7     Act does not receive the vote necessary for immediate effect, this
 2-8     Act takes effect September 1, 2001.
