                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the advertising of competitive bids by counties.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 262.025(a), Local Government Code, is
 1-5     amended to read as follows:
 1-6           Sec. 262.025(a) A notice of a proposed purchase must be
 1-7     published at least once a week in a newspaper of general
 1-8     circulation in the county or posted electronically on the Internet,
 1-9     with the first day of publication occurring before the 14th day
1-10     before the date of the bid opening.  When posting advertising on
1-11     the Internet, the county must post the notice for 14 consecutive
1-12     days so that it is accessible with the universal resource locator
1-13     address of "HTTP://WWW.CO. (county-name).TX.US/NOTICES/INDEX.HTM".
1-14     If there is no newspaper of general circulation in the county, and
1-15     the notices are not posted on the internet, the notice must be
1-16     posted in a prominent place in the courthouse for 14 days before
1-17     the date of the bid opening.
1-18           SECTION 2.  Section 263.007(b), Local Government Code, is
1-19     amended to read as follows:
1-20           Section 263.007(b) The procedure must include a requirement
1-21     that the county publish, before the sale or lease is made, a notice
1-22     of its intent to sell or lease, as appropriate, the real property.
1-23     The notice must:
 2-1                 (1)  be published in a newspaper of general circulation
 2-2     in the county the commissioners court represents and, if the real
 2-3     property is located in another county, in a newspaper of general
 2-4     circulation in that other county and/or posted electronically on
 2-5     the Internet; posting on the Internet would satisfy requirements
 2-6     for advertising in multiple counties;
 2-7                 (2)  be published on two dates, with the date of the
 2-8     second publication occurring before the 14th day before the date
 2-9     the award of the sale or lease is made;
2-10                 (3)  include a description of the real property,
2-11     including its location; and
2-12                 (4)  include a description of the procedure by which
2-13     sealed bids or sealed proposals for the sale or lease may be
2-14     submitted.
2-15           SECTION 3.  Section 263.153(a), Local Government Code, is
2-16     amended to read as follows:
2-17           Sec. 263.153(a) The commissioners court shall publish notice
2-18     of a sale of surplus or salvage property in at least one newspaper
2-19     of general circulation in the county and/or posted electronically
2-20     on the Internet.
2-21           SECTION 4.  Section 271.055(b)(1), Local Government Code, is
2-22     amended to read as follows:
2-23           Sec. 271.055(b)(1) be published once a week for two
2-24     consecutive weeks in a newspaper, as defined by Subchapter C,
2-25     Chapter 2051, Government Code, that is of general circulation in
2-26     the area of the issuer and/or posted electronically on the
 3-1     Internet, with the date of the first publication to be before the
 3-2     14th day before the date set for the public opening of the bids and
 3-3     the reading of the bids aloud; and
 3-4           SECTION 5.  This Act takes effect September 1, 2001.
