                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to requiring the Texas Natural Resource Conservation
 1-3     Commission to study brick-making processes near the Texas-Mexico
 1-4     border.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  DEFINITION.  In this Act, "commission" means the
 1-7     Texas Natural Resource Conservation Commission.
 1-8           SECTION 2.  BRICK-MAKING PROCESSES STUDY.  (a)  The
 1-9     commission shall conduct a study of the brick-making processes of
1-10     brick production facilities near both sides of the border between
1-11     this state and Mexico.
1-12           (b)  The commission shall survey current fuel sources for
1-13     kilns, including the use of scrap wood and sawdust, tires, and
1-14     other inefficient or highly polluting fuels.
1-15           (c)  In conducting the study, the commission shall solicit
1-16     the advice of experts from institutions of higher education,
1-17     government, and industry of the United States and Mexico on
1-18     efficient processes and fuels for maintaining proper temperatures
1-19     for brick production while minimizing emissions of air pollutants.
1-20           (d)  The commission shall consider the information collected
1-21     in the study and make recommendations on efficient processes to
1-22     decrease air pollutant emissions from brick-making kilns.
1-23           (e)  The commission shall issue a report to the governor,
1-24     lieutenant governor, and speaker of the house of representatives
1-25     that summarizes the information gathered in and conclusions of the
 2-1     study and that highlights the recommendations.  The report must be
 2-2     issued not later than January 1, 2003.
 2-3           SECTION 3.  EXPIRATION.  This Act expires January 1, 2003.
 2-4           SECTION 4.  EFFECTIVE DATE.  This Act takes effect
 2-5     immediately if it receives a vote of two-thirds of all the members
 2-6     elected to each house, as provided by Section 39, Article III,
 2-7     Texas Constitution.  If this Act does not receive the vote
 2-8     necessary for immediate effect, this Act takes effect September 1,
 2-9     2001.

2-11           Amend S.B. No. 905 in SECTION 2 of the bill, in Subsection
2-12     (a), between "commission" and "shall" (Senate Engrossment page 1,
2-13     line 9), by inserting ", in cooperation with the Joint Advisory
2-14     Committee for improvement of Air Quality,
