 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the purposes and duties of defense base development
 1-9     authorities.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Section 378.001, Local Government Code, as added
1-12     by Chapter 1221, Acts of the 76th Legislature, Regular Session,
1-13     1999, is amended to read as follows:
1-14           Sec. 378.001.  DEFINITIONS.  In this chapter:
1-15                 (1)  "Authority" means a defense base development
1-16     authority established under this chapter.
1-17                 (2)  "Base efficiency project" means a demonstration
1-18     project between a municipality and the United States Department of
1-19     Defense to evaluate and demonstrate methods for more efficient
1-20     operation of military installations through improved capital asset
1-21     management and greater reliance on the public or private sector for
1-22     less costly base support services and to improve mission
1-23     effectiveness and reduce the cost of providing quality installation
1-24     support at military facilities under Pub. L. No. 106-246 or other
1-25     applicable federal laws.
1-26                 (3)  "Base property" means land inside the boundaries
1-27     of the defense base for which the authority is established and
1-28     improvements and personal property on that land.
1-29                 (4) [(3)]  "Board" means the board of directors of the
1-30     authority.
1-31                 (5) [(4)]  "Bond" means an interest-bearing obligation
1-32     issued by an authority under this chapter, including a bond,
1-33     certificate, note, or other evidence of indebtedness.
1-34                 (6) [(5)]  "Defense base" means a military installation
1-35     or facility that is:
1-36                       (A)  closed or realigned under the Defense Base
1-37     Closure and Realignment Act of 1990 (10 U.S.C. Section 2687 note)
1-38     and its subsequent amendments; or
1-39                       (B)  the subject of a base efficiency project.
1-40           SECTION 2.  Section 378.003, Local Government Code, as added
1-41     by Chapter 1221, Acts of the 76th Legislature, Regular Session,
1-42     1999, is amended to read as follows:
1-43           Sec. 378.003.  PURPOSE AND NATURE OF AUTHORITY.  (a)  An
1-44     authority is created to:
1-45                 (1)  accept title to or operate under a lease from the
1-46     United States or any other person all or a part of the base
1-47     property and areas around the base property[;] and
1-48                 [(2)]  engage in the economic development of the base
1-49     property and areas around the base property; or
1-50                 (2)  carry out a base efficiency project.
1-51           (b)  An authority created under Subsection (a)(2) may not
1-52     operate a defense base that has been closed or realigned under the
1-53     Defense Base Closure and Realignment Act of 1990 (10 U.S.C. Section
1-54     2687 note) and its subsequent amendments.
1-55           (c)  An authority exercises public and essential governmental
1-56     functions.
1-57           SECTION 3.  Subsection (a), Section 378.008, Local Government
1-58     Code, is amended to read as follows:
1-59           (a)  The board of an authority shall, if consistent with the
1-60     purposes for which the authority was created under Section 378.003:
1-61                 (1)  monitor the proposed closing of the defense base;
1-62                 (2)  manage and operate the defense base transition and
1-63     development on behalf of the municipality that established the
1-64     authority;
 2-1                 (3)  review options related to the most appropriate use
 2-2     of the defense base;
 2-3                 (4)  conduct a study on issues related to the closure,
 2-4     conversion, redevelopment, and future use of the defense base;
 2-5                 (5)  formulate, adopt, and implement a plan to convert
 2-6     and redevelop the defense base; [and]
 2-7                 (6)  submit the plan to an appropriate agency or
 2-8     agencies of the federal government; and
 2-9                 (7)  manage the property used for a base efficiency
2-10     project.
2-11           SECTION 4.  This Act takes effect September 1, 2001.
