1-1 AN ACT
1-2 relating to the procurement powers of certain navigation districts
1-3 and port authorities.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter N, Chapter 60, Water Code, is amended
1-6 by adding Section 60.4125 to read as follows:
1-7 Sec. 60.4125. ALTERNATIVE METHODS FOR CERTAIN PURCHASES OR
1-8 CONTRACTS. (a) Notwithstanding the other provisions of this
1-9 subchapter or any other law, a district or port authority may make
1-10 a purchase or enter into a contract valued at $25,000 or more by
1-11 any method available to a school district, including all procedures
1-12 and limitations, under Subchapter B, Chapter 44, Education Code,
1-13 that, in the opinion of the port commission, provides the best
1-14 value to the district or port authority.
1-15 (b) Subsection (a) does not apply to a purchase or a
1-16 contract for the construction of highways, public roads, public
1-17 streets, bridges, water supply projects, water plants, wastewater
1-18 plants, or electric generation facilities.
1-19 (c) Subsection (a) does not apply to contracts when the
1-20 district or port authority is constructing a project for another
1-21 political subdivision of the state.
1-22 SECTION 2. This Act takes effect immediately if it receives
1-23 a vote of two-thirds of all the members elected to each house, as
1-24 provided by Section 39, Article III, Texas Constitution. If this
1-25 Act does not receive the vote necessary for immediate effect, this
2-1 Act takes effect September 1, 2001.
