No. 925 By: Brown 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to the procurement powers of certain navigation districts 1-11 and port authorities. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Subchapter N, Chapter 60, Water Code, is amended 1-14 by adding Section 60.4125 to read as follows: 1-15 Sec. 60.4125. ALTERNATIVE METHODS FOR CERTAIN PURCHASES OR 1-16 CONTRACTS. (a) Notwithstanding the other provisions of this 1-17 subchapter or any other law, a district or port authority may make 1-18 a purchase or enter into a contract valued at $25,000 or more by 1-19 any method available to a school district, including all procedures 1-20 and limitations, under Subchapter B, Chapter 44, Education Code, 1-21 that, in the opinion of the port commission, provides the best 1-22 value to the district or port authority. 1-23 (b) Subsection (a) does not apply to a purchase or a 1-24 contract for the construction of highways, public roads, public 1-25 streets, bridges, water supply projects, water plants, wastewater 1-26 plants, or electric generation facilities. 1-27 (c) Subsection (a) does not apply to contracts when the 1-28 district or port authority is constructing a project for another 1-29 political subdivision of the state. 1-30 SECTION 2. This Act takes effect immediately if it receives 1-31 a vote of two-thirds of all the members elected to each house, as 1-32 provided by Section 39, Article III, Texas Constitution. If this 1-33 Act does not receive the vote necessary for immediate effect, this 1-34 Act takes effect September 1, 2001. 1-35 * * * * *
