1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to eligibility for assignment of former or retired
1-11 statutory probate judges as visiting judges.
1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13 SECTION 1. Subsection (x), Section 25.0022, Government Code,
1-14 is amended to read as follows:
1-15 (x) To be eligible for assignment under this section a
1-16 former or retired judge of a statutory probate court must:
1-17 (1) not have been removed from office; [and]
1-18 (2) certify under oath to the presiding judge, on a
1-19 form prescribed by the state board of regional judges, that the
1-20 judge did not resign from office after having received notice that
1-21 formal proceedings by the State Commission on Judicial Conduct had
1-22 been instituted as provided in Section 33.022 and before the final
1-23 disposition of the proceedings;
1-24 (3) certify to the presiding judge a willingness not
1-25 to appear and plead as an attorney in any court in the judge's
1-26 county of residence or a contiguous county for a period of two
1-27 years; and
1-28 (4) certify to the presiding judge a willingness not
1-29 to accept appointment as a guardian ad litem, guardian of the
1-30 estate of an incapacitated person, or guardian of the person of an
1-31 incapacitated person in any court in the judge's county of
1-32 residence or a contiguous county for a period of two years.
1-33 SECTION 2. (a) The change in law made by this Act applies
1-34 only to the assignment of a former or retired statutory probate
1-35 judge as a visiting judge on or after the effective date of this
1-36 Act.
1-37 (b) This Act takes effect September 1, 2001.
