                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the applicability of municipal zoning ordinances to
 1-3     open-enrollment charter schools.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 12.103, Education Code, is amended to
 1-6     read as follows:
 1-7           Sec. 12.103.  APPLICABILITY OF LAWS, [AND] RULES, AND
 1-8     ORDINANCES TO OPEN-ENROLLMENT CHARTER SCHOOL.  (a)  An
 1-9     open-enrollment charter school is subject to federal and state laws
1-10     and rules governing public schools and to municipal zoning
1-11     ordinances governing public schools, except that an open-enrollment
1-12     charter school is subject to this code and rules adopted under this
1-13     code only to the extent the applicability to an open-enrollment
1-14     charter school of a provision of this code or a rule adopted under
1-15     this code is specifically provided.
1-16           (b)  Notwithstanding Subsection (a), a campus of an
1-17     open-enrollment charter school located in whole or in part in a
1-18     municipality with a population of 20,000 or less is not subject to
1-19     municipal zoning ordinances governing public schools.
1-20           SECTION 2.  This Act takes effect September 1, 2001.
