A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the duration of a hunting or fishing license, stamp,
1-3 tag, or permit.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 42.0175(a), Parks and Wildlife Code, is
1-6 amended to read as follows:
1-7 (a) A license issued under this chapter, other than a
1-8 lifetime resident hunting license or a nonresident five-day special
1-9 hunting license, is valid from the date of issuance through the day
1-10 before the first anniversary of the date of issuance [only during
1-11 the yearly period for which the license is issued without regard to
1-12 the date on which a license is acquired. Each yearly period begins
1-13 on September 1 or on another date set by the commission and extends
1-14 through August 31 of the next year or another date set by the
1-15 commission. A license issued under this chapter other than a
1-16 nonresident five-day special hunting license that is issued before
1-17 September 1 or another date set by the commission and does not
1-18 expire until August 31 of the next year or another date set by the
1-19 commission is valid from the date of issuance through August 31 of
1-20 the following year or another date set by the commission. The
1-21 commission by rule may set the amount of a license fee for a
1-22 license issued during a transition period at an amount lower than
1-23 prescribed in this chapter and provide for a license term for a
1-24 transition period that is shorter or longer than a year].
2-1 SECTION 2. Section 43.012(d), Parks and Wildlife Code, is
2-2 amended to read as follows:
2-3 (d) A stamp issued under this subchapter is valid for
2-4 hunting from the date of issuance through the day before the first
2-5 anniversary of the date of issuance [only during the yearly period
2-6 for which the stamp is issued without regard to the date on which
2-7 the stamp is acquired. A yearly period begins on September 1 or
2-8 another date set by the commission and extends through August 31 of
2-9 the next year or another date set by the commission. The
2-10 commission by rule may set the amount of a stamp fee for a stamp
2-11 issued during a transition period at an amount lower than
2-12 prescribed in this subchapter and provide for a stamp term for a
2-13 transition period that is shorter or longer than a year].
2-14 SECTION 3. Section 43.045, Parks and Wildlife Code, is
2-15 amended to read as follows:
2-16 Sec. 43.045. DURATION OF LICENSE. A hunting lease license
2-17 is valid from the date of issuance through the day before the first
2-18 anniversary of the date of issuance [for the period from September
2-19 1 or another date set by the commission through August 31 of the
2-20 next year or another date set by the commission. The commission by
2-21 rule may set the amount of a license fee for a license issued
2-22 during a transition period at an amount lower than prescribed in
2-23 this subchapter and provide for a license term for a transition
2-24 period that is shorter or longer than a year].
2-25 SECTION 4. Section 43.0722(f), Parks and Wildlife Code, is
2-26 amended to read as follows:
2-27 (f) The private bird hunting area license is valid from the
3-1 date of issuance through the day before the first anniversary of
3-2 the date of issuance [from September 1 or another date set by the
3-3 commission through August 31 of the next year or another date set
3-4 by the commission. The commission by rule may set the amount of a
3-5 license fee for a license issued during a transition period at an
3-6 amount lower than prescribed in this subchapter and provide for a
3-7 license term for a transition period that is shorter or longer than
3-8 a year].
3-9 SECTION 5. Section 43.201(e), Parks and Wildlife Code, is
3-10 amended to read as follows:
3-11 (e) A stamp issued under this subchapter is valid for
3-12 hunting from the date of issuance through the day before the first
3-13 anniversary of the date of issuance [only during the yearly period
3-14 for which the stamp is issued without regard to the date on which
3-15 the stamp is acquired. Each yearly period begins on September 1 or
3-16 another date set by the commission and extends through August 31 of
3-17 the next year or another date set by the commission. The

3-22 SECTION 6. Section 43.252(e), Parks and Wildlife Code, is
3-23 amended to read as follows:
3-24 (e) A stamp issued under this subchapter is valid for
3-25 hunting from the date of issuance through the day before the first
3-26 anniversary of the date of issuance [only during the yearly period
3-27 for which the stamp is issued without regard to the date on which
4-1 the stamp is acquired. Each yearly period begins on September 1 or
4-2 another date set by the commission and extends through August 31 of
4-3 the next year or another date set by the commission. The

4-5 issued during a transition period at an amount lower than

4-8 SECTION 7. Section 43.303(e), Parks and Wildlife Code, is
4-9 amended to read as follows:
4-10 (e) A stamp issued under this subchapter is valid for
4-11 hunting from the date of issuance through the day before the first
4-12 anniversary of the date of issuance [only during the yearly period
4-13 for which the stamp is issued without regard to the date on which
4-14 the stamp is acquired. Each yearly period begins on September 1 or
4-15 another date set by the commission and extends through August 31 of
4-16 the next year or another date set by the commission. The
4-17 commission by rule may set the amount of a stamp fee for a stamp
4-18 issued during a transition period at an amount lower than
4-19 prescribed in this subchapter and provide for a stamp term that is
4-20 shorter or longer than a year].
4-21 SECTION 8. Section 43.4035, Parks and Wildlife Code, is
4-22 amended to read as follows:
4-23 Sec. 43.4035. EXPIRATION OF STAMP. (a) Except as provided
4-24 by Subsection (b) [or (c)], a stamp issued under this subchapter is
4-25 valid for fishing from the date of issuance through the day before
4-26 the first anniversary of the date of issuance [only during the
4-27 yearly period for which the stamp is issued without regard to the
5-1 date on which the stamp is acquired. Each yearly period begins on
5-2 September 1 or another date set by the commission and extends
5-3 through August 31 of the next year or another date set by the
5-4 commission. The commission by rule may set the amount of a stamp
5-5 fee for a stamp issued during a transition period at an amount
5-6 lower than prescribed in this subchapter and provide for a stamp
5-7 term for a transition period that is shorter or longer than a
5-8 year].
5-9 (b) [A saltwater sportfishing stamp issued before September
5-10 1 or another date set by the commission that does not expire until
5-11 August 31 of the following year or another date set by the
5-12 commission is valid from the date of issuance through August 31 of
5-13 the following year or another date set by the commission.]
5-14 [(c)] A saltwater sportfishing stamp issued in conjunction
5-15 with a license issued under Section 46.005 or 46.0051 of this code
5-16 expires at the same time the license expires or on the expiration
5-17 date printed on the stamp, whichever is later.
5-18 SECTION 9. Section 43.508, Parks and Wildlife Code, is
5-19 amended to read as follows:
5-20 Sec. 43.508. EXPIRATION OF STAMP. (a) Except as provided
5-21 by Subsection (b) [or (c)], a stamp issued under this subchapter is
5-22 valid for fishing from the date of issuance through the day before
5-23 the first anniversary of the date of issuance [only during the
5-24 yearly period for which the stamp is issued without regard to the
5-25 date on which the stamp is acquired. Each yearly period begins on
5-26 September 1 or another date set by the commission and extends
5-27 through August 31 of the next year or another date set by the
6-1 commission. The commission by rule may set the amount of a stamp
6-2 fee for a stamp issued during a transition period at an amount
6-3 lower than prescribed in this subchapter and provide for a stamp
6-4 term for a transition period that is shorter or longer than a
6-5 year].
6-6 (b) [A freshwater trout stamp issued before September 1 or
6-7 another date set by the commission that does not expire until
6-8 August 31 of the next year or another date set by the commission is
6-9 valid from the date of issuance through August 31 of the next year
6-10 or another date set by the commission.]
6-11 [(c)] A freshwater trout stamp issued in conjunction with a
6-12 license issued under Section 46.005 or 46.0051 expires at the same
6-13 time the license expires or on the expiration date printed on the
6-14 stamp, whichever is later.
6-15 SECTION 10. Section 43.582(c), Parks and Wildlife Code, is
6-16 amended to read as follows:
6-17 (c) A stamp issued under this subchapter is valid for
6-18 hunting from the date of issuance through the day before the first
6-19 anniversary of the date of issuance [only during the yearly period
6-20 for which the stamp is issued without regard to the date on which
6-21 the stamp is acquired. Each yearly period begins on September 1 or
6-22 another date set by the commission and extends through August 31 of
6-23 the next year or another date set by the commission. The
6-24 commission by rule may set the amount of a stamp fee for a stamp
6-25 issued during a transition period at an amount lower than
6-26 prescribed in this subchapter and provide for a stamp term for a
6-27 transition period that is shorter or longer than a year].
7-1 SECTION 11. Sections 46.007(a), (d), (e), and (f), Parks and
7-2 Wildlife Code, are amended to read as follows:
7-3 (a) Except as provided by Subsections (b), (c), (d), and
7-4 (e)[, and (f) of this section], a license required or authorized by
7-5 this subchapter is valid from the date of issuance through the day
7-6 before the first anniversary of the date of issuance [only during
7-7 the yearly period for which it is issued without regard to the date
7-8 on which the license is acquired. Each yearly period begins on
7-9 September 1 or another date set by the commission and extends
7-10 through August 31 of the next year or another date set by the
7-11 commission. The commission by rule may set the amount of a license
7-12 fee for a license issued during a transition period at an amount
7-13 lower than prescribed in this section and provide for a license
7-14 term for a transition period that is shorter or longer than a
7-15 year].
7-16 (d) [A license issued under Section 46.004 of this code that
7-17 is issued before September 1 or another date set by the commission
7-18 and does not expire until August 31 of the following year or
7-19 another date set by the commission is valid from the date of
7-20 issuance through August 31 of the following year or another date
7-21 set by the commission.]
7-22 [(e)] A lifetime resident fishing license is valid for the
7-23 lifetime of the license holder.
7-24 (e) [(f)] A duplicate license is valid for the period of
7-25 validity of the original license only.
7-26 SECTION 12. Section 46.104(a), Parks and Wildlife Code, is
7-27 amended to read as follows:
8-1 (a) A Lake Texoma fishing license is valid from the date of
8-2 issuance through the day before the first anniversary of the [until
8-3 December 31 following its] date of issuance.
8-4 SECTION 13. Section 47.031(a), Parks and Wildlife Code, is
8-5 amended to read as follows:
8-6 (a) All licenses and permits issued under the authority of
8-7 Chapter 47 of this code are valid from the date of issuance through
8-8 the day before the first anniversary of the date of issuance [only
8-9 during the yearly period for which they are issued without regard
8-10 to the date on which the licenses are acquired. Each yearly period
8-11 begins on September 1 or another date set by the commission and
8-12 extends through August 31 of the next year or another date set by
8-13 the commission. The commission by rule may set the amount of a
8-14 license fee for a license issued during a transition period at an
8-15 amount lower than prescribed in this chapter and provide for a
8-16 license term for a transition period that is shorter or longer than
8-17 a year].
8-18 SECTION 14. Section 47.078, Parks and Wildlife Code, is
8-19 amended to read as follows:
8-20 Sec. 47.078. EXPIRATION OF LICENSE. A license required by
8-21 this subchapter is valid from the date of issuance through the day
8-22 before the first anniversary of the date of issuance [only during
8-23 the period for which it is issued without regard to the date on
8-24 which the license is acquired. Each period is one year beginning
8-25 on September 1 or another date set by the commission].
8-26 SECTION 15. Section 50.0021, Parks and Wildlife Code, is
8-27 amended to read as follows:
9-1 Sec. 50.0021. EXPIRATION OF LICENSES. (a) Except as
9-2 provided by Subsection [Subsections] (b) [and (c) of this section],
9-3 a license required or authorized by this chapter is valid from the
9-4 date of issuance through the day before the first anniversary of
9-5 the date of issuance [only during the yearly period for which the
9-6 license is issued without regard to the date on which the license
9-7 is acquired. Each yearly period begins on September 1 or another
9-8 date set by the commission and extends through August 31 of the
9-9 next year or another date set by the commission. The commission by
9-10 rule may set the amount of a license fee for a license issued
9-11 during a transition period at an amount lower than prescribed in
9-12 this chapter and provide for a license term for a transition period
9-13 that is shorter or longer than a year].
9-14 (b) [A license issued under the authority of this chapter
9-15 that is issued before September 1 or another date set by the
9-16 commission and does not expire until August 31 or another date set
9-17 by the commission of the following year is valid from the date of
9-18 issuance through August 31 of the following year or another date
9-19 set by the commission.]
9-20 [(c)] A lifetime resident combination hunting and fishing
9-21 license is valid for the lifetime of the license holder.
9-22 SECTION 16. Section 65.0071, Parks and Wildlife Code, is
9-23 amended to read as follows:
9-24 Sec. 65.0071. EXPIRATION OF LICENSES. A license issued
9-25 under this chapter is valid from the date of issuance through the
9-26 day before the first anniversary of the date of issuance [only
9-27 during the yearly period for which the license is issued without
10-1 regard to the date on which the license is acquired. Each yearly
10-2 period begins on September 1 or another date set by the commission
10-3 and extends through August 31 of the next year or another date set
10-4 by the commission. The commission by rule may set the amount of a
10-5 license fee for a license issued during a transition period at an
10-6 amount lower than prescribed in this chapter and provide for a
10-7 license term for a transition period that is shorter or longer than
10-8 a year].
10-9 SECTION 17. Section 66.017(a), Parks and Wildlife Code, is
10-10 amended to read as follows:
10-11 (a) All licenses, tags, and permits issued under the
10-12 authority of Chapter 66 [of this code] are valid from the date of
10-13 issuance through the day before the first anniversary of the date
10-14 of issuance [only during the yearly period for which they are
10-15 issued without regard to the date on which the licenses are
10-16 acquired. Each yearly period begins on September 1 or another date
10-17 set by the commission and extends through August 31 of the next
10-18 year or another date set by the commission. The commission by rule
10-19 may set the amount of a license fee for a license issued during a
10-20 transition period at an amount lower than prescribed in this
10-21 chapter and provide for a license term for a transition period that
10-22 is shorter or longer than a year].
10-23 SECTION 18. Section 71.010, Parks and Wildlife Code, is
10-24 amended to read as follows:
10-25 Sec. 71.010. LICENSE PERIOD. The license period for
10-26 licenses issued under this chapter is from the date of issuance
10-27 through the day before the first anniversary of the date of
11-1 issuance [September 1 or another date set by the commission through
11-2 August 31 of the next year or another date set by the commission,
11-3 and a license is current and valid only for the license period for
11-4 which it is issued. The commission by rule may set the amount of a
11-5 license fee for a license issued during a transition period at an
11-6 amount lower than prescribed in this chapter and provide for a
11-7 license term for a transition period that is shorter or longer than
11-8 a year].
11-9 SECTION 19. Section 76.1031(a), Parks and Wildlife Code, is
11-10 amended to read as follows:
11-11 (a) All licenses issued under the authority of Chapter 76
11-12 [of this code] are valid from the date of issuance through the day
11-13 before the first anniversary of the date of issuance [only during
11-14 the yearly period for which they are issued without regard to the
11-15 date on which the licenses are acquired. Each yearly period begins
11-16 on September 1 or another date set by the commission and extends
11-17 through August 31 of the next year or another date set by the
11-18 commission. The commission by rule may set the amount of a license
11-19 fee for a license issued during a transition period at an amount
11-20 lower than prescribed in this chapter and provide for a license
11-21 term for a transition period that is shorter or longer than a
11-22 year].
11-23 SECTION 20. Section 77.0361(a), Parks and Wildlife Code, is
11-24 amended to read as follows:
11-25 (a) All licenses issued under the authority of Chapter 77
11-26 [of this code] are valid from the date of issuance through the day
11-27 before the first anniversary of the date of issuance [only during
12-1 the yearly period for which they are issued without regard to the
12-2 date on which the licenses are acquired. Each yearly period begins
12-3 on September 1 or another date set by the commission and extends
12-4 through August 31 of the next year or another date set by the
12-5 commission. The commission by rule may set the amount of a license
12-6 fee for a license issued during a transition period at an amount
12-7 lower than prescribed in this chapter and provide for a license
12-8 term for a transition period that is shorter or longer than a
12-9 year].
12-10 SECTION 21. Section 78.002(b), Parks and Wildlife Code, is
12-11 amended to read as follows:
12-12 (b) The license form shall be prescribed by the department
12-13 and shall designate the water in which the licensee may operate.
12-14 All licenses issued under the authority of Chapter 78 [of this
12-15 code] are valid from the date of issuance through the day before
12-16 the first anniversary of the date of issuance [only during the
12-17 yearly period for which they are issued without regard to the date
12-18 on which the licenses are acquired. Each yearly period begins on
12-19 September 1 or another date set by the commission and extends
12-20 through August 31 of the next year or another date set by the
12-21 commission. The commission by rule may set the amount of a license
12-22 fee for a license issued during a transition period at an amount
12-23 lower than prescribed in this chapter and provide for a license
12-24 term for a transition period that is shorter or longer than a
12-25 year].
12-26 SECTION 22. Section 78.108, Parks and Wildlife Code, is
12-27 amended to read as follows:
13-1 Sec. 78.108. EXPIRATION OF LICENSE. A license required by
13-2 this subchapter is valid from the date of issuance through the day
13-3 before the first anniversary of the date of issuance [only during
13-4 the period for which it is issued without regard to the date on
13-5 which the license is acquired. Each period is one year beginning
13-6 on September 1 or another date set by the commission].
13-7 SECTION 23. (a) This Act takes effect September 1, 2001.
13-8 (b) The changes in law made by this Act apply only to a
13-9 license, stamp, tag, or permit issued by the Parks and Wildlife
13-10 Department on or after September 1, 2002.
