A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the salaries of certain justices and judges and to the
1-3 authority of a county to supplement those salaries.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 31.001, Government Code, is amended to
1-6 read as follows:
1-7 Sec. 31.001. AUTHORITY FOR COUNTY PAYMENT OF COMPENSATION.
1-8 The commissioners courts in the counties of each of the 14 courts
1-9 of appeals districts may pay an annual salary [an amount not to
1-10 exceed $15,000 a year] to each of the justices of the courts of
1-11 appeals residing within the court of appeals district that includes
1-12 those counties. The payment is for all judicial and administrative
1-13 services performed by the justices.
1-14 SECTION 2. Section 32.001, Government Code, is amended by
1-15 amending the section heading to read as follows:
1-16 Sec. 32.001. AUTHORITY FOR COUNTY PAYMENT OF SALARY
1-17 [ANDERSON COUNTY].
1-18 SECTION 3. Section 32.001(a), Government Code, is amended to
1-19 read as follows:
1-20 [(a)] The commissioners court of a county [Commissioners
1-21 Court of Anderson County] may pay an annual salary to each of the
1-22 judges of the district courts having jurisdiction in the county.
1-23 The payment is for all [an annual salary not to exceed $1,200 for]
1-24 judicial and administrative services performed by the judge.
2-1 SECTION 4. Section 32.002, Government Code, is amended by
2-2 amending the section heading to read as follows:
2-3 Sec. 32.002. SALARY ADDITIONAL [ANDREWS COUNTY].
2-4 SECTION 5. Section 32.002(c), Government Code, is amended to
2-5 read as follows:
2-6 [(c)] The salary authorized by Section 32.001 is in addition
2-7 to the salary paid by the state.
2-8 SECTION 6. Subchapter A, Chapter 32, Government Code, is
2-9 amended by adding Section 32.003 to read as follows:
2-10 Sec. 32.003. MONTHLY INSTALLMENTS. The salary authorized by
2-11 Section 32.001 shall be paid in monthly installments from the
2-12 county general fund or another available fund of the county.
2-13 SECTION 7. Sections 659.012(a) and (e), Government Code, are
2-14 amended to read as follows:
2-15 (a) Notwithstanding Section 659.011:
2-16 (1) a justice of the supreme court is entitled to an
2-17 annual salary from the state that is at least $102,463;
2-18 (2) a justice of a court of appeals other than the
2-19 chief justice is entitled to an annual salary from the state that
2-20 is five percent less than the salary provided by the General
2-21 Appropriations Act for a justice of the supreme court[, except that
2-22 the combined salary of a justice of the court of appeals other than
2-23 the chief justice from all state and county sources may not exceed
2-24 the amount that is $1,000 less than the salary provided for a
2-25 justice of the supreme court];
2-26 (3) the chief justice of a court of appeals is
2-27 entitled to an annual salary from the state that is $2,500 more
3-1 than the salary provided for the other justices of the court of
3-2 appeals[, except that the combined salary of the chief justice of a
3-3 court of appeals may not exceed the amount that is $500 less than
3-4 the salary provided for a justice of the supreme court]; and
3-5 (4) a judge of a district court is entitled to an
3-6 annual salary from the state that is 10 percent less than the
3-7 salary provided in the General Appropriations Act for a justice of
3-8 the supreme court[, except that unless otherwise provided by law,
3-9 the combined salary of a district judge from state and county
3-10 sources may not exceed the amount that is $2,000 less than the
3-11 salary provided for a justice of the supreme court].
3-12 (e) For the purpose of salary payments by the state, the
3-13 comptroller shall determine from sworn statements filed by the
3-14 justices of the courts of appeals and district judges that the
3-15 required salary differentials provided by this section are
3-16 maintained. [If a salary combined with a county supplement would
3-17 be in excess of the differential provided by this section, the
3-18 comptroller shall reduce the state salary by the amount of the
3-19 excess.]
3-20 SECTION 8. Sections 31.003, 32.001(b)-(d), 32.002(a) and
3-21 (b), 32.004-32.253, and 659.012(b), Government Code, are repealed.
3-22 SECTION 9. This Act takes effect September 1, 2001.
