1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to certain requirements for the composition of a local
1-11 workforce development board.
1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13 SECTION 1. Subsection (b), Section 2308.255, Government
1-14 Code, is amended to read as follows:
1-15 (b) The appointments must:
1-16 (1) be consistent with the local government agreement
1-17 and applicable federal and state law; [and]
1-18 (2) reflect the ethnic and gender [geographic]
1-19 diversity of the workforce development area; and
1-20 (3) reflect the geographic diversity of the workforce
1-21 development area by:
1-22 (A) including at least one member from each
1-23 county in the workforce development area; and
1-24 (B) ensuring equal representation from each
1-25 commissioners precinct in the county if the board is in a county
1-26 with a population of more than one million.
1-27 SECTION 2. If the change in law made by this Act by the
1-28 amendment of Subsection (b), Section 2308.255, Government Code,
1-29 conflicts with federal law or would have the effect of invalidating
1-30 a waiver granted under federal law, the chief elected officials
1-31 responsible for appointing the members of a local workforce
1-32 development board are not required to comply with the change made
1-33 by this Act.
1-34 SECTION 3. (a) This Act takes effect September 1, 2001.
1-35 (b) The change in law made by this Act applies to a local
1-36 workforce development board created on or after the effective date
1-37 of this Act.
1-38 (c) The chief elected officials responsible for appointing
1-39 members to a local workforce development board created before the
1-40 effective date of this Act shall appoint new members to the board
1-41 that reflect the requirements of this Act as vacancies occur on the
1-42 board or as the terms of members serving on the board on or before
1-43 the effective date of this Act expire.
