1-1 AN ACT
1-2 relating to loss control programs for insurance companies.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subsection (a), Article 5.06-4, Insurance Code,
1-5 is amended to read as follows:
1-6 (a) Any insurer desiring to write commercial automobile
1-7 liability insurance in this state must provide loss control
1-8 information as a prerequisite for writing [a license to write] that
1-9 insurance.
1-10 SECTION 2. Subsection (a), Article 5.15-2, Insurance Code,
1-11 is amended to read as follows:
1-12 (a) Any insurer desiring to write professional liability
1-13 insurance for hospitals in Texas shall maintain or provide loss
1-14 control facilities as a prerequisite for writing [a license to
1-15 write] such insurance. Such facilities shall be adequate to
1-16 furnish loss control services required by the nature of its
1-17 policyholder's operations and shall include surveys,
1-18 recommendations, training programs, consultations, and analyses of
1-19 accident causes. Each field safety representative shall be either
1-20 a college graduate who shall have a bachelor's degree in science or
1-21 engineering, a bachelor of arts degree in nursing, a bachelor of
1-22 science degree in nursing, pharmacy, or physical therapy, or a
1-23 master's degree in hospital administration, or shall be a
1-24 registered professional engineer, a certified safety professional,
1-25 a certified industrial hygienist, an individual with 10 years'
2-1 experience in occupational safety and health, or an individual who
2-2 shall have completed a course of training in loss control services
2-3 approved by the State Board of Insurance.
2-4 SECTION 3. Subsection (a), Article 5.15-3, Insurance Code,
2-5 is amended to read as follows:
2-6 (a) Any insurer desiring to write professional liability
2-7 insurance for insureds other than hospitals, general liability
2-8 insurance, or medical professional liability insurance for insureds
2-9 other than hospitals in this state must provide loss control
2-10 information as a prerequisite for writing [a license to write] that
2-11 insurance.
2-12 SECTION 4. Subsection (a), Section 411.061, Labor Code, is
2-13 amended to read as follows:
2-14 (a) As a prerequisite for writing [a license to write]
2-15 workers' compensation insurance in this state, an insurance company
2-16 must maintain or provide accident prevention facilities that are
2-17 adequate to provide accident prevention services required by the
2-18 nature of its policyholders' operations.
2-19 SECTION 5. This Act takes effect September 1, 2001.
