1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to loss control programs for insurance companies.
1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10 SECTION 1. Subsection (a), Article 5.06-4, Insurance Code,
1-11 is amended to read as follows:
1-12 (a) Any insurer desiring to write commercial automobile
1-13 liability insurance in this state must provide loss control
1-14 information as a prerequisite for writing [a license to write] that
1-15 insurance.
1-16 SECTION 2. Subsection (a), Article 5.15-2, Insurance Code,
1-17 is amended to read as follows:
1-18 (a) Any insurer desiring to write professional liability
1-19 insurance for hospitals in Texas shall maintain or provide loss
1-20 control facilities as a prerequisite for writing [a license to
1-21 write] such insurance. Such facilities shall be adequate to
1-22 furnish loss control services required by the nature of its
1-23 policyholder's operations and shall include surveys,
1-24 recommendations, training programs, consultations, and analyses of
1-25 accident causes. Each field safety representative shall be either
1-26 a college graduate who shall have a bachelor's degree in science or
1-27 engineering, a bachelor of arts degree in nursing, a bachelor of
1-28 science degree in nursing, pharmacy, or physical therapy, or a
1-29 master's degree in hospital administration, or shall be a
1-30 registered professional engineer, a certified safety professional,
1-31 a certified industrial hygienist, an individual with 10 years'
1-32 experience in occupational safety and health, or an individual who
1-33 shall have completed a course of training in loss control services
1-34 approved by the State Board of Insurance.
1-35 SECTION 3. Subsection (a), Article 5.15-3, Insurance Code,
1-36 is amended to read as follows:
1-37 (a) Any insurer desiring to write professional liability
1-38 insurance for insureds other than hospitals, general liability
1-39 insurance, or medical professional liability insurance for insureds
1-40 other than hospitals in this state must provide loss control
1-41 information as a prerequisite for writing [a license to write] that
1-42 insurance.
1-43 SECTION 4. Subsection (a), Section 411.061, Labor Code, is
1-44 amended to read as follows:
1-45 (a) As a prerequisite for writing [a license to write]
1-46 workers' compensation insurance in this state, an insurance company
1-47 must maintain or provide accident prevention facilities that are
1-48 adequate to provide accident prevention services required by the
1-49 nature of its policyholders' operations.
1-50 SECTION 5. This Act takes effect September 1, 2001.
