A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to funding to enable Prairie View A&M University to
1-3 qualify for agricultural research, extension, and education
1-4 matching funds, including federal agricultural research and
1-5 extension formula funds.
1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-7 SECTION 1. Subchapter B, Chapter 87, Education Code, is
1-8 amended by adding Section 87.107 to read as follows:
1-9 Sec. 87.107. STATE FUNDING TO MATCH FEDERAL FORMULA FUNDS
1-10 FOR AGRICULTURAL RESEARCH AND EXTENSION OR OTHER NONSTATE FUNDS.
1-11 (a) For each state fiscal year, the legislature shall appropriate
1-12 for agricultural research and extension programs at Prairie View
1-13 A&M University from the general revenue fund or other available
1-14 sources an amount equal to the amount of nonfederal matching funds
1-15 required in that fiscal year to enable those programs to meet the
1-16 matching fund requirement to receive the maximum amount of federal
1-17 formula funds available under Section 1449(c), National
1-18 Agricultural Research, Extension, and Teaching Policy Act of 1977
1-19 (7 U.S.C. Section 3222d).
1-20 (b) For each state fiscal year, the legislature shall
1-21 appropriate from the general revenue fund or other available
1-22 sources an additional amount equal to 10 percent of the amount
1-23 described by Subsection (a) to the university for agricultural
1-24 research, extension, education, or other qualifying activities that
2-1 enable the programs conducting those activities to qualify for
2-2 additional federal funds that become available under Section
2-3 1449(f), National Agricultural Research, Extension, and Teaching
2-4 Policy Act of 1977 (7 U.S.C. Section 3222d), or for matching
2-5 agricultural research, extension, or education funds from any other
2-6 federal program or from any source not funded from revenue of this
2-7 state.
2-8 (c) The portion of an appropriation made under Subsection
2-9 (a) or (b) not used or obligated in the applicable fiscal year to
2-10 obtain or qualify for matching funds under Subsection (a) or (b)
2-11 lapses at the end of the fiscal year.
2-12 SECTION 2. This Act takes effect immediately if it receives
2-13 a vote of two-thirds of all the members elected to each house, as
2-14 provided by Section 39, Article III, Texas Constitution. If this
2-15 Act does not receive the vote necessary for immediate effect, this
2-16 Act takes effect September 1, 2001.
