                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to county regulation of sexually oriented businesses
 1-3     located within the corporate boundaries of a municipality.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 243.003(c), Local Government Code, is
 1-6     amended to read as follows:
 1-7           (c)  A regulation adopted by a county applies only to the
 1-8     parts of the county outside the corporate limits of a municipality,
 1-9     except as provided by Section 243.0065.
1-10           SECTION 2. Chapter 243, Local Government Code, is amended by
1-11     adding Section 243.0065 to read as follows:
1-12           Sec. 243.0065.  COUNTY REGULATION WITHIN CORPORATE LIMITS OF
1-13     MUNICIPALITY PERMITTED IN LIMITED CIRCUMSTANCES. A county may
1-14     enforce the county's distance regulation adopted under Section
1-15     243.006(a)(2) in connection with a sexually oriented business
1-16     located in a municipality if:
1-17                 (1)  that business is located in one municipality;
1-18                 (2)  the specified land use described by Section
1-19     243.006(a)(2) is located in another municipality; and
1-20                 (3)  either municipality requests the county to enforce
1-21     the county's distance regulation.
1-22           SECTION 3. This Act takes effect September 1, 2001.
