By: Lindsay S.B. No. 1060 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the transferability of appropriations and the 1-3 suspension of statutory restrictions on the use of certain 1-4 appropriations made to the Texas Natural Resource Conservation 1-5 Commission. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. Chapter 5, Water Code, is amended by adding 1-8 Section 5.707 to read as follows: 1-9 Sec. 5.707. TRANSFERABILITY OF APPROPRIATIONS AND FUNDS 1-10 DERIVED FROM FEES. Notwithstanding any law that provides specific 1-11 purposes for which a fund, account, or revenue source may be used 1-12 and expended by the commission and that restricts the use of 1-13 revenues and balances by the commission, the commission may 1-14 transfer a percentage of appropriations from one appropriation item 1-15 to another appropriation item consistent with the General 1-16 Appropriations Act for any biennium authorizing the commission to 1-17 transfer a percentage of appropriations from one appropriation item 1-18 to another appropriation item. The use of funds in dedicated 1-19 accounts under this section for purposes in addition to those 1-20 provided by statutes restricting their use may not exceed seven 1-21 percent or $20 million, whichever is less, of appropriations to the 1-22 commission in the General Appropriations Act for any biennium. A 1-23 transfer of $500,000 or more from one appropriation item to another 1-24 appropriation item under this section must be approved by the 1-25 commission at an open meeting subject to Chapter 551, Government 2-1 Code. 2-2 SECTION 2. This Act takes effect September 1, 2001. 2-3 COMMITTEE AMENDMENT NO. 1 2-4 Amend S.B. No. 1060 in SECTION 1 of the bill, at the end of 2-5 added Section 5.707, Water Code (Senate Engrossment page 2, line 2-6 1), by adding the following: 2-7 The commission shall notify the governor and the Legislative Budget 2-8 Board of any decision to reallocate funds between accounts prior to 2-9 any such reallocations. 2-10 Luna
