No. 1061 1-2 (In the Senate - Filed March 2, 2001; March 6, 2001, read 1-3 first time and referred to Committee on Intergovernmental 1-4 Relations; March 28, 2001, reported favorably by the following 1-5 vote: Yeas 7, Nays 0; March 28, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the power of certain rapid transit authorities to call 1-9 an election. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter B, Chapter 451, Transportation Code, 1-12 is amended by adding Section 451.072 to read as follows: 1-13 Sec. 451.072. GENERAL AUTHORITY TO CALL ELECTION: CERTAIN 1-14 AUTHORITIES. (a) This section applies only to an authority in 1-15 which the principal municipality has a population of more than 1.2 1-16 million. 1-17 (b) The board of an authority may call an election to 1-18 determine the voters' will on any issue that the board is 1-19 authorized to decide under this chapter or on the exercise of any 1-20 discretionary power of the board under this chapter. At the time 1-21 the board orders the election, the board shall specify whether the 1-22 results of the election are binding on the authority. 1-23 (c) The board shall specify the ballot proposition for an 1-24 election called under this section. A ballot proposition is 1-25 approved if a majority of the voters voting at the election favor 1-26 the proposition. 1-27 SECTION 2. This Act takes effect September 1, 2001. 1-28 * * * * *
