                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to development regulations in certain counties.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 231.222, Local Government Code, is
 1-5     amended to read as follows:
 1-6           Sec. 231.222.  Areas Subject to Regulation.  This subchapter
 1-7     applies only to the unincorporated areas of Fort Bend, Hays, and
 1-8     Hood County.
 1-9           SECTION 2.  Section 231.223, Local Government code, is
1-10     amended to read as follows:
1-11           Sec. 231.223.  Development Regulations Generally.  The
1-12     Commissioners Courts of Fort Bend, Hays, and Hood County may
1-13     regulate:
1-14           (1)  the percentage of a lot that may be occupied or
1-15     developed;
1-16           (2)  population density;
1-17           (3)  the size of buildings;
1-18           (4)  the location, design, construction, extension, and size
1-19     of streets and roads;
1-20           (5)  the location, design, construction, extension, size, and
1-21     installation of water and wastewater facilities, including the
1-22     requirements for connecting to a centralized water or wastewater
1-23     system;
 2-1           (6)  the location, design, construction, extension, size, and
 2-2     installation of drainage facilities and other required public
 2-3     facilities;
 2-4           (7)  the location, design, and construction of parks,
 2-5     playgrounds, and recreational areas; and
 2-6           (8)  the abatement of harm resulting from inadequate water or
 2-7     wastewater facilities.
 2-8           SECTION 3.  This act takes effect September 1, 2001.
