No. 1110 By: Moncrief 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to reports concerning the prosecution of offenses 1-11 committed because of bias or prejudice. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Chapter 2, Code of Criminal Procedure, is amended 1-14 by adding Article 2.27 to read as follows: 1-15 Art. 2.27. REPORT OF OFFENSE COMMITTED BECAUSE OF BIAS OR 1-16 PREJUDICE. Not later than the 30th day after the date on which a 1-17 judgment is entered in a criminal case in which an affirmative 1-18 finding under Article 42.014 is requested by the attorney 1-19 representing the state, the court clerk shall notify the office of 1-20 the attorney general of that fact. The court clerk shall include 1-21 in the report a statement as to whether the affirmative finding was 1-22 entered in the judgment in the case. 1-23 SECTION 2. This Act takes effect immediately if it receives 1-24 a vote of two-thirds of all the members elected to each house, as 1-25 provided by Section 39, Article III, Texas Constitution. If this 1-26 Act does not receive the vote necessary for immediate effect, this 1-27 Act takes effect September 1, 2001. 1-28 * * * * *
