                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to conflicts of interest of Department of Information
 1-3     Resources employees.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 2054.022(b) is amended to read as
 1-6     follows:
 1-7           (b)  [A person who is the spouse of an officer, employee, or
 1-8     paid consultant of a business entity that has, or of a trade
 1-9     association of business entities that have, a substantial interest
1-10     in the information resources technologies industry and that may
1-11     contract with state government may not be:]
1-12           [(1)  a member of the board; or]
1-13           [(2)  an employee of the department who:]
1-14                 [(A)  is exempt from the state's position classification
1-15     plan; or]
1-16                 (B)  [is compensated at or above the amount prescribed
1-17     by the General Appropriations Act for step 1, salary group 17, of
1-18     the position classification schedule.]
1-19     The department shall remove from the bidding process, including
1-20     development of the proposal through award of the contract and
1-21     contract negotiation, any employee who receives more than 5 percent
1-22     of the individual's income from any likely respondent to a bid
1-23     proposal issued by the department, or whose spouse is employed by
 2-1     any likely respondent to a bid proposal issued by the department.
 2-2           SECTION 2.  This Act takes effect September 1, 2001.
